You are right. Check cases with RFE already replied to, you will find most of the RFE cases have been approved within 2 weeks after the responses.

RFE for I-140 is bad. For EB1A is still bad. It will ask you to prove you are top in your field, international influence etc. You will also need stronger and more reference letter from leaders in your field. A lot of work.



I don't agree.

It really depends. If your case is strong and you have no problem to accommodate whatever the extra documents USCIS requests, RFE is good because it means USCIS has started to process the case. On the other hand, if your case is weak and you have problem to provide the extra evidences, it is really bad.

Topic: Experience letter question -previous experience in India

My former employers are in the US. USCIS didn't call the people who gave the experience letters but did raise an RFE to my attorney to request the letters with the detailed description of responsibilities.

Therefore, you need to provide experience letters with enough details. Otherwise, you will get an RFE.

Topic: I140 - Address Change..

I don't agree.

Please check USCIS web site and it states clearly that you need to do an online address change for each pending case even if you have already filed AR-11.


Please note, it is important to file AR-11 in case you change your address. Filing AR-11 will update your address on your pending applications with USCIS automatically and you dont need to file any address change or amendement for any of pending applications. Process is very simple which is file AR-11 only.

If you dont file, due to any reason or by any other way if USCIS will see your new address or send any thing on your old address and it returned back, you will be in trouble as you did not follow the USCIS rule of address change.

some people reported on forums that once they filed AR-11, they got RFE of Geographic location change as it was not matching any more with their petition. In that case, simply Employer verification letter is sufficient to reply for RFE to
mention that you are working for the same company with your salary on it etc. but it does not happen with every one. and it is not an issue at all.

If you still have fear of RFE, talk to your lawyer about it and do what your lawyer suggest.

Once RFE is replied ,
1. how long does it take to reach USCIS.
2. how long it takes to update the status as " document recd".

Publish your views pls



My attorney used Fedex overnight to mail the response and the RFE was received the 2nd day. The status of my case got updated on the same day when they received the response.

The response time depends. Each RFE is different. My RFE requires the employment verification letters from all of my former employers including one in another state. Therefore, the RFE notice gives me 2.5 months for the response.

By the way, you should have let USCIS know whenever you move. Because you have pending cases, you should have done BOTH of two following things.

1. Send an AR-11 form with your updated information to USCIS.
2. Update your address on line at USCIS' web site.

Whether it is an approval notice or a denial notice, this is bad news for you. Because even if your notice is an approval, the case will be denied if the notice cannot be delivered.

You should contact USCIS ASAP.

Does NSC is hell for EB3s?
I am saying yes...they are not processing EB3 140 petitions like EB2s..
It is a hell for EB3s , even they are not processing 10 petitions per month....They should give same priority to all EB petiition like what TSC is doing.



Sorry for the harsh words, but you had better spend time more constructively. Complaining is of no use. It is better for you to use the time to improve your English. Frankly speaking, with your English level, it is hard to survive in the US smoothly as a professional.

All in all, may you have good luck in your 140 petition.

Thanks, buddy. Actually my former boss has promised to give me the letter next Monday. He is a nice guy. It was a pity that he couldn't be my boss any more because he moved to another department. I had to change my job a few months after he moved.
