Of course ! If you see other threads there has been a sudden surge of approvals of LC's for one of those desi mnc.I woder the cause for this effect from DOL. But you are right it is in their interest to lobby for opposing the EAD and increasing H1-B because their entire business model is based on bringing low paid workers on H1-B and pay only the bare minimum prevailing wages.

Its not the companies,its their attorney's.they will loose their butter and bread .They charge thousands of dollars in H1-B extensions and if the backlog goes away who will file for extension ?

You are wrong here.America is not more a melting pot.It's instead a fruit basket now having different flavours.Even their companies are teaching this in the induction programs of new employees.My company had a very great discussion at this point and everyone agreed it's no more a melting pot.No one wishes to lose their identity.

The rule in its current form is too restrictive !The H4 EAD person is totally dependent on H1-B person maintaining the status and if he/she changes the job then the H4 will have to wait till the new PERM/I-140 gets approved.

Thanks ! I am not sure about employment laws in Ohio.Any idea how to find a good attorney ? I just don't want others like me to fall into the trap specially ppl on H1-B as it is vey difficult to find a new job if someone runs into these situation and working on a visa.

Yes but i am wondering why would someone do that.They spent lot of money on my initial H1-B,extension and PERM filing.Unfortunately the PERM went to Audit.Also if they are racists why should they hire ppl like me unless they are pressured from top.Later i came to know that lot of work went to TCS and their CIO sent a mail about outsourcing and lot of culture change withing the company due to some of the work being outsourced to TCS.

Hi,

I want to ask a question to the experienced members on this forum.
Here is my case history.
I used to work for a small apprael retailer in columbus, OH.
The company revenues are around $5 Billion.
During my employment with the company i was severly bullied by the manager.I worked with the company for 1 year on H1-B visa.
My manager was a white lady recently got widowed and had been promoted to manager .She moved from minnesota to columbus.
Initially i had no clue that i was being bullied but later i realized it was intentional. In one of the meetings about one of our testing cycles there were so many issues and i was supposed to fix those . The code was developed by other ppl.
So if there are 100 isses she asked me to go to everyone's cube if i need any info rather than sending emails.
I said that if i go like that and there are 100's if issues i will appear like dancing. She said that 'yes you will'.
I felt very upset and scheduled a meeting with her later, she clearly denied that she told any such thing.
That lady severely micromanged and took accountability for each hour. I had to send her the hour by hour accountability on each Thursday for the full 40 hr week even though i was an exempt employee.
When i worked from she made sure that i had something to do however irrelavant it was and took the status in the evening.
When she was working remote she used to give some work without mentioning any purpose of that task and scheduled meeting on evening or next morning to review what i have done. Once it was reviewed that work was never used or mentioned in future meaning the work was given to make sure i burn 8 hours mandatorily.
Sometimes she even used to cancel those meeting 5 mins before without any reason.
She always used the phrase All hands on the deck and always wanted me to work in shifts or overtime since the original plans always failed and it always ended in fire fighting. She used to say that its team work but i was the only member in her team . There were 3 others who were loaned from a different team temporarily and then there were some old guys who were with the company for last 27 yrs,they seem to be her buddies.
There was no clarity in the work assigments and everything was ambigous giving her a lot of space to blame.
She even depreciated the use of email communication so that nothing is in writing.
Whenever i have question she asked me to ask her verbally rather than on email.When i asked her verbally she gave confusing answers and later backtracked that she said anything.The whole environment was seriously sadistic.
My other teammate who was loaned from different team asked for a release and he finally got assigned to different team . He later told me this lady tried a lot to stop him from leaving the team and even tried to bribe him by saying that she will get him promoted to manager in couple of years but he did'nt listened and left the team sensing her bullying behavior.
Sometimes she used to give impossible tasks and if i speak something she retaliated by giving more such tasks and hard timelines.
I later reached out to her superior what was going on . He was a director and had joined the company few months back.
I asked him to release me from the team and gave reason that I want to learn something new.He said he will look into it and talk to his boss.
After couple of days there was another altercation between me snd that lady.She had given me some task last week which i had completed, she came to my desk ,i was briwsing gmail on my iphone .
She asked me what i am working on and i told her i just complted the task she allocated me last week and was going to meet her for next task.Meanwhile i got an issue in testing which i was working on.
i went to restroom and later i found a paper slip on my phone asking me to meet her in some conf room.
I went there ,she scolded me why i did'nt come to her when i had no task. She was visibily furious and was repeateadly showing T sign with her hand.I tried to igone first time but she was stuck on same topic so i got furious an slammed the laptop lid and walked out telling her i am going to HR.
Later i complained to her boss and told everything.He asked me to give a proof and scheduled a meeting later.
Later i showed him some proofs and some emails where she backtracked from her words. He told me that she complained to him about my iphone incident to which he told that even he browes iphone in office.
Later he tried to bribe me that he will give promotion and asked me to keep tolerating.
There were couple of more incidents like that and finally being tired i went to HR and complained.
The HR seemed to be on managers side but declined to relase me from team.
They said they provide the feedback and take corrective actions on managers rather than moving resources.
I kept tolerating and later i declined one of the meeting set by the manager because i was sure i would be grilled .
The director caught this and immediately set up a meeting next day and told me some junk which i recorded on phone.
He asked me to find a new job as he thinks that this company is not a right fit for me.
I was later put in Individual development Plan and was given 'Does not meet wxpectations' rating.
I had ro go through lot of harassment following this since i had to report status every alternate day.So i took one month leave and found a new job.
Later on when i returned that lady looked very upset and my Individual dev plan started from where i left it.It looked like she was not expecting me but after 2 days i resigned.
HR asked the reason and i tolfd i am not a right fit fir the role.
Later on i got to know there was one other team mate who left job one month after me.
Thinking back i suspect that lady manager was racist and disliked me.It felt like she and her old buddies at the company had personal vendetta against foreign nationals.The director (her boss )might have been involved as well.

I want to know is it possible to file a harassment case against the employer.i dont have many proofs except some voice recordings since they restricted email communication.
I am not interested in money but want to teach that manager snd company HR a lesson.I feel very frustated that i had to go through all this.
Please advise !
