Did u file using e-file or paper filing to USCIS?

I filed ours on Dec 11th 2008, no response yet.

Another possibility is he may have used cros chargeability, but didnt disclose in his trackitt case details.

or as folks have suggested in the past in this forum and elsewhere, this could be a sincere mistake by the USCIS officer who approved this case without verifying the PD and country of chargeability.

USCIS is a black hole, lot of the processes are still unknown to the public, some of their systems are outdated and old...you can think of thousands of such reasons for this kind of mistakes.

Wait for your turn and see if they dont approve your case when your PD is current and your receipt date is passed their processing times report, you have a right to open SR( service request) and check your case status with USCIS.

Hey in this country atleast govt servents work without accepting bribe, what would you do in india, where just by bribing corrupt givt officials one can bypass the normal processing queue.

It is very much a possibility that he was allocated visa number when his PD was current for a while in USCIS FY 2008 (oct 2007 to Sept 2008). It was just pending some processing and finally when they processed his application he received his GC.

USCIS officer at times do allocate the visa numbers and keep file pending for some minor processing work.

This is nothing to do with any luck or bribing someone to bypass the queue.

So be patient, when you file is processed and the visa number is available, you will receive your GC. Except for answering you dont have to do anything special during this wait time and if their is no RFE u simply do nothing but wait for the CRIS e-mails in your mailbox.

No worry be happy, and dont get mad at USCIS. Let them do their job.

my apologies for suggesting my PD is like yours, I guess it was some other poster in this forum who had March 2003 PD for India EB-3 category.

You better check with your company attorneies too on the process of changing the status from PAROLED to H1B, but this is what i have been told when i had similar situation and consult with my immigration attorney.

What i have been told that if u r working for the sponsoring employer, you dont even need to inform USCIS, you will be in H1B status until you GC is approved.

Read the corresponding memos and you will see tons of information. Check Murthy.com, it is very good resource for the immigrants.

Manusingh,

Please note that when you enter on AP, the I-94 is valid for 1 year, so i guess your currnt I-94 which came along with the new H1B extention has the same number as what you had when you entered using AP on the Paroled status.

Since USCIS use your last entry status to process the H1B extentions and then use the same I-94 number in their approval notice and shows status as H1B.

so what will happen now is once you surrender this I-94 to the airlines, when you use your new AP document, CBP inspector will issue you a new I-94 after admitting you as in PAROLED status.

Their is a way with additional filing you can change your status from PAROLED to H1B, but you may have to bear those expences...and i dont know if your employer or you will be willing to do the change of status from PAROLED to H1B with new I-94 showing yur status as H1B again.

I am in the similar situation, working as H1B for a GC sponsoring employer, but my attorney is suggesting so long as I work for the same employer my status is H1B and pending AoS ( dual intent).

If I travel to india next year , i will use my renewed AP and will keep doing it until I get my GC.

FYI...my Pd is almost like yours...June 2003...so hopefully by end of 2009 or maybe beginning of 2010 we see our GREEN card.

Their is USCIS memo regarding the staus of H1B and pending AoS (I-485). do google search for this and u will fidn those links.

to answer your question about use of AP: the answer is Yes if you dont want to stamp the new H1B visa on your passport, you can use the renewed AP and be in PAROLED status as they gave you while u entered using your 1st AP.

IF you have time and money to go to the US consulate in India and get the new H1B stamp, you are fine, you can enter on H1B status without any need for Advance PArole.

H1B is dual intent status and allowes you to be in both AoS pending and H1B status as long as you are working for the GC sponsoring employer.

yes you do for both paper and e-file u need to send 2 recent PP size photograph with white background and on the back of the phots write your Name and A# ( It should be avilable on your I-485 receipt notice).

Topic: What is the impact of Employer revoking approved I140

IF your friend hires good attorney and invokes AC-21 by informing USCIS abut his job change and his new employer is willing to accept the responsibilities for answering future RFEs related to your friend's employment then he should be fine.

Employer simply revoking approved I-140 will not have any effect on his pending I-485.

Go ahead and do the AC-21 as thats the only way to get out of this desi consultant. HE will not be able to revoke I-140 very easily...they simply threaten to do so, but will not take any action.

Ask your friend to leave this guy on friendly terms, means dont keep anything pending with this guy, complete all the assignments at the current client site and payoff whatever money he has agreed upon in the initial contract when the desi consultant hired him and start processing his GC...He may be after few $$$ he spent on your friend's GC.

If she has not travelled since, just put class of last admission to US as H-4 as whats her current I-94 represents. No matter she is working on EAD.

Once you use the AP to enter US, then it would be PAROLED.
