Guys:
MY 485 IS NOT DENIED:
I am just asking if it is denied..the options..
Can i use AC21 and change employer.. as i have my approve 140..and my 485 was bending more than 180 days.. or once we get the 485 denial we can not use AC21 ?
OR i can file another 485 with other company with my approved 140? |

I applied concurrently for 140 /485 - Subsitute labor through Company A in Aug 2006
Right now working with Company B
140 got approved...in May
485 RFE (Didn't get the physical RFE)
My Question is:
For whatever the strange reason if my 485 denied. what are my options?
I don't have any H1B left. currently working on EAD.
Please let me know

Topic: what if the previous beneficery got green card using the priority date - substitute labor
One of my frinds has the situvation:
Company A filled a 140 substitution for him
The original benificery of this 140 left the company, the compnay A did not revoke the 140 application
the Original benificery got his green card through other company and we are assuming that he used the priority date of the 140 approved by company A
Now the company A trying to substitute the 140 for the new employee(my friend). But the USCIS is saying it is not unable to find the original labor.
my question is: If the previous employee got his green card thorough company B using the priority date of the approved 140 from company A, my friend can not use this 140?
I hope i give a clear detail without confusing.. If anyone have any previous experience and how you dealt with this please advise

I am not working for the company which got the 140 approval. I am working for a different company. So the EVL. letter may be for the company i am working for now i guess.. |

Will my 485 face any problem? If there is a problem, i can use AC21.. will it help?

YEA: They have a system which doesn't work as any other USCIS system.
I have done my finger print December 2006... It expired long time back.. i never get any finger print..
So one day they may wake-up and send a finger print notice..
I assume that when they are in the final stage before adjudication, they will check the finger print validity, if it expired they will ask for a new finger print.
So nobody can help except GOD.. |

My lawyer is planning to file a Law-Suite against USCIS for not approving the 485 application which has priority date of 2001 and RD 2006: And USCIS didn't respond to the SR also..Same old stories.. wait for 45-60 days...etc. (And they are approving 2005 and 2006 priority date... that is depressing...Hi People with 2005 or 2006 priority date, please do not send the hate mails buddies..Just i am depressed LOL you can understand)
Did any one file Law-Suite? or it there any other option?
