Topic: L1 blanket petition for extension and lawful status

Hello all, I was trying to help a friend who is here on L1 blanket visa, but not well aware of his possible next steps. Hopefully I can get some advice here. Following is his situation.

I797 Petition valid indefinitely
I129S Blanket L petition valid till 19 Jan 2018
Visa stamp expiry date in passport 09 Apr 2018
I94 expiry date 08 Sep 2020

With these dates in mind I suggested him he can stay legally until his I94 expiry date that is 08 Sep 2020 but here are the 2 questions -
1) When is it required to file petition for L1 blanket extension?
2) Until what date can he work legally?

Please suggest. Thanks.

Topic: How long does it take to withdraw I140 petition?

How long does it take to withdraw I140 once the withdrawal request is submitted to USCIS by the employer? How fast does USCIS process such request, is there a queue or delay in withdrawing I140 petitions?

Topic: EAD for H4 Visa Holders

Are H4 spouses of H1 visa holders under AC21 Section 104(c) eligible for EAD?

Following link only talks about AC21 106(a) and (b) but nothing about 104(c). Please suggest.

Topic: H4 EAD approved then I-140 revoked

Hi,

I wanted to ask about the following situation regarding H4 EAD :-

I got 140 from Employer A. After USCIS starts accepting applications, I applied H4 EAD and got approved. Then I moved to Employer B. Then Employer A revoked 140. What happens to the already approved H4 EAD?

Can you please clarify?

Thanks.

03/05/2015: Exciting News for EBs - USCIS Schedules Teleconference for Employment-based Reform Parts of Obama Immigration Actions 03/19/2015

It is going to be a listening session but will provide an overview of the new initiatives and seek your input on enhancements. It appears that the USCIS intends to wrap up its mandated proposals to the President and they seek inputs. For details, please stay tuned to this website.

Whats surprising is out of 16 cosponsors + 1 sponsor, 11 are repubs and only 6 are dems. All these days dems were supporting immigration reform, I was hoping dems would take the lead in cosponsor numbers.

Please visit HR213 to bring it to first rank of most visited bills of the week. This will increase the visibility of this bill and may increase the chances of getting passed. Congress graphs most visited bills every week as shown in the following links. Currently HR213 is at position 8 and lets keep it at number 1 every week to help ourselves. This is the same journey HR240 has taken and got passed recently.

Is it fine if we have an approved, unrevoked I-140 from previous employer? Or do we have to have I-140 from current employer who currently holds our H1B. Please suggest.

We still have minimum 4 steps. Steps 1 and 2 are a cycle that the rule could get stuck in. Considering one month for each step, we still have to wait for 5 more months, so target for July or August.

1) USCIS must submit a final version to OMB for review
2) OMB could approve or send it back to USCIS for corrections
3) OMB gives its approval
4) Published in the Federal Register
5) Implementation date should be announced
