All,

I got "card production ordered" email from CRIS this morning.

I had 2 I-140s approved (under EB2 and EB3) before my I-485 was filed. I contacted Local Congresswoman immigration staff and USCIS Ombudsman office few months back. I think that helped my case. Around Mid-Sept. I was told by my congresswoman staff that I should hear on my case in 90-120 days. My case has been approved before 90 days.

You need your congressman staff to understand the situation and then request them to call your processing center (NSC/TSC) and get them straight. This is the only way to do it.

I had both I-140s (EB3 with PD of Oct. 2002 and EB2 with PD of Aug 2006) approved before I filed my I-1485. Funny thing is that USCIS returned my I-485 application first because EB2 date was not current at that time, my attorney sent application back to USCIS with a cover letter mentioing we want to use EB3 PD under EB2 visa classification and USCIS accepted my I-485 application. So Ideally, I would think my case should be straignt forward but there is nothing straight forward at USCIS :)

I looked at I-824, I do not see anything like "action to amend previous decision"

Wtng4Ever: congrats !!

Is there a USCIS form for "interfiling" or just a letter from Attorney to USCIS ?

my attorney told me that she needs to send a letter with my 2 approved I-140s (EB2 and EB3) receipts copies.

1) When did you file for "interfling" ?
2) did you recieve any interfling confirmation letter from TSC/USCIS after "interfiling" before you got your I-485 case approved ?
3) When was your I-485 approved ?

You are right. dates can be ported. I guess it does complcate the case pending with USCIS. There is another thread going on called "linking EB Dates". There are lots of people who have ported their dates (that is what they think including me) but none of them have got approval yet thought theirs PD is current for a while and RD is quite old as well.

Please let me know how many times you had Finger printing done and when was the last time you got it done.

I got 2nd FP notice for myself but not for my wife and daughter. My date is current since April Ist, 2008 and PD is Oct. 2002.

My DHS-7001 form was received by Ombudsman office on July 30th and I got a letter on 8/13 and phone call on 8/14

I sent DHS-7001 with a cover letter mentioning my case details. From my experience, I would suggest that cover letter should have follwoing information:

I-485 case receipt number : < > File number : < >
Add same information for your secondary applicants (wife, kids)
Immigrant Visa Classification: EB2
Priority Date:

EB2 I-140 case number :
EB2 I-140 approval date:
EB2 I-140 PD :

EB3 I-140 case number :
EB3 I-140 approval date:
EB3 I-140 PD :

According to 8 C.F.R. Section 204.5(e), I am entitled to carry over the earlier priority date of my approved EB3 petition to my approved EB2 petition. Sept. 2008 cutoff date for EB2 is . Accordingly, my priority date is current and a VISA number IS AVAILABLE. I would appreciate your attention to this matter in adjudicating mine and my family’s applications.
