You are good to switch to AC21, but make sure your previous employer should not touch your approved 1-140 some time,
You may ger RFE during I-485 to prove still you are doing similar kind of job, they may ask show your recent payslips and offer letter. 90% - 10% chancess ( 90% good, 10% may issues )

I don't want discarage you , but chancess are very less. If you are really lucky then it will approve.

I recomend always better to file another labor under EB3 ASAP.

They have to prove ability to pay from labour filing date, for example if they file your GC in 2008 and approve, if you file I-140 in 2009 then they will ask from 2008 to tll date.

Anyway You are safe, you have 3 yearsvalid H1, I suggest, better to file new PERM labor , labour and I-140 will approve in 1 yr max.

Looks like nothing is wromng with your I-140, If I-140 reject then I-485 reject , but if I-485 reject then no impact on I-140 unless untill your employer revoke it.

You are in safe, you can work on H1 and start new PERM process

Topic: Future Employment.

I am working for company A, I filed Labour 365 days before my h1 expires, OCT-2007 through company B, labour approved in 45 days, I waited 5 months and in 6th month may-2008 filed I-140 this is EB2 catg, it approved on Aug-02.

I filed EB3 I-140 & I-485 with sub labour July-2007 through Company C, I-140 got RFE so that filed new PERM labor under EB2 for backup through Company B.

My profile shows EB3 details through company C.
