One thing to remember is that the GC is intent for a future job. I don't think that it would look to good if you applied and got your GC and then the employer moved, especially as that they know they would be moving around that time already.

My understand is that there is a grace period for the H1. My lawyer mentioned it to me while I was doing the renewal. Ask him if he knows more about this grace period and specifically about your case. |

Absolutely correct.
This is an important point that should not be overlooked by people who have just received their EAD cards. EAD does give you the flexibility to work for another company but you do abandon your H1 status.
If for whatever reason you i485 is denied and you have used your EAD you would have no valid status. Whereas if you are on your H1 you would could fall back on that.
This really is a personal decision and a fact of how comfortable you feel with the above. |

The priority date is something that is established by your labour/perm certification. It should be on your I140 notice. |

I wouldn't count on using these two LUDs to get a reliable idea of what the situation is with the GC.
I responded to an RFE in August, got a LUD for that and then two further luds on the 27 and 28 August and nothing since then.
I'm still waiting.

I think that we have seen a slow down to a virtual stop as we have come to the end of the visa year. If anything I would expect things to pick up a little in October but we'll have to see.

I would say we have to wait for October now. I don't know what the process time is for apart from delaying inquiry requests. It seems that a lot of people are approved before the process time.
Apparently my case is that my FP is cleared, NC is cleared and case is with an officer.
Hopefully October will be a good month for all of us.

I don't think so. The priority date is set by the i140 application which also sets the EB category. So my thought would be that changing the category would require a new i140 application. This is my thought but you should check with your lawyer.
Interesting question though.
Just as a last note why wouldn't you apply for the highest EB category you could in the first place? |
