Topic: Wait time between marriage and filing for AOS

Congratulations to you and to your spouse for getting married soon.

Presume one of the spouses is a US Citizen or a Permanant Resident to be eligible for sponsoring a famiy based 130/145.

Regarding filing GC What is the hurry? Are you getting married for a grean card or for LOVE?

If you are getting married for love..just .enjoy life together, now and always, go places together, visit places of worship together, open joint bank accounts, file joint income tax returns ensure your house lease is joint and includes names of both, have joint car, life insurance, common credit cards, nams of both in utilities like telephone connection etc., ask friends and relatives to send you letters/greeting cards with names of both. Get a genuine Marriage Registration Certificate. And take lots and lots of photographs, both during courting (now), during marriage ceremony and later at home and while visiting places together, with friends and with relatives both yours and his. Thus while enjoying life together, create maximum possible and irrefutable evidences not only of your courting, marriage but also of a very happy married life together.

And as soon as you are sure that you really love each other, that you are enjoying married life, want to live together always, and your marriage is stable, apply for Green Card. Now even Almighty cannot refuse you entry into the Green Heaven.

Topic: Immediate Family Based I-130/485 concurrent 2008 filers (for Parents) only.

I find most discussions on family based concurrent filers is for cases filed about spouses only.
I therefore wish to start a new discussion for Parents only who have filed in the year 2008.
Come on, let us share our problems, experiences and progress of our cases.

Our particulars are as follows:

Filed on Aug. 28, 2008 for both parents at Chicago Loc Bax.
Received date" Aug. 29, 2008
Filed by US Citizen
Country of origin: INDIA
Procesing Service center: California
Finger Printing on Sep. 19, 2008 at Los Angeles
EAD approved on Nov. 10
AP approved on Nov. 10
I-130 pending at USCIS office
I-485 pending at CSC.

Normallly no interview for parents of citizens.
No relationship with EAD and AP
I-130 usuallly within 5-6 months from date of receipt
I-485 usually within 6-12 months fom date of receipt.(presuming no RFE)

Topic: Help!! on "Notice Returned as Undeliverable"

I have personal experience and have gone through this problem when my EAD card and Parole were returned back. Notice returned as undeliverable means that an important govt. letter such as a card or a parole was sent probably with the instructions that it should be delivered only to addressee if he lives there. These instructions may sometimes be in the bar code which PO computer system can read easily..

If you had instructed the Post Office to forward your mail any time earlier, to another address, and even if you had cancelled the forwarding instructions, these instructions may still be in the PO computer system. In such circumstances, the mail will be returned back to USCIS, and not delivered at the address mentioned in the envelope nor forwarded to the forwarding address.

Even if you manage to get your mail resent by changing your address at the customer support or by taking an infopasas appointment, the resent mail will again be returned as undeliverable, making USCIS suspect that you are a fraud and donot live at the given address.

Therefore you should take necessary action for resending your mail both by talking to customer support, correcting your address, if any and also by taking an infopass appointmnt, but you should also ensure that any forwarding mail instructions given to your post office earlier are cancelled. This might require more than one visit to your post office to make them understand your problem and ensure that in future no mail received from USCIS gets returned by their computer system or by mailman.

Please do check with the post office , if you ever had made a request for forwarding your mails to another address, and later even cancelled the forwarding but the fact remains in their computer system. In that case importatnt mails such as ead, ap and green cards are returned back to USCIS as undeliverable mail without reaching your mailman.

Yes I have received AP on Dec.04.
Actually it was mailed on Nov 12 to my address. Unfortunately I had temporarily asked the Post office to forward my mails to another address about 6 months ago and later cancelled the forwarding; However cancellation of forwarding was not in the system. Therefore my AP got returned automatically as important mails like EAD cards/AP/Green Cards etc/which are required to be forwarded are neither delivered nor forwarded but only returned automatically by the PO computer system. fortunately the PO computer system also gave my forwarding address. After the mail got 'not deliverable returned'to NBC they again sent my AP to my forwarding address and I recd it on Dec 4. In the mean time I opend service request for resending back my mail, and also took an Infopass appointment for
Dec.8 but that was not required;.

my EAD and AP are also approved and received. Filed concurrently on Aug 28.

Now my I-485 is pending at CSC and I-130 is pending at a USCIS location.

I thought first I130 is processed at a service center and then .I-485 is processed at a field office.

What is happening. Any ideas?
