I think instead of getting railed up on forums EB2 and EB3 people should have worked at a simple change like putting a minimum salary of $150K or something for EB1C. I am not a legal expert but something like that could have been easily accomplished through some rulemaking process etc with help from hard line senators like Graasley. That could have contained the flood of EB1C both in I and ROW. In stead of channeling our energies towards something like that we are just wasting our energy venting our frustrations on the forums.

Topic: How to close 401k with pending I-485 & Job loss

Your PD is Sep 2008, you seems to have filed 485 for the first time and it is less than 1 year so your medicals should also be current. With that you should not even get a RFE and should be receiving GC any time. With that your employment status should not be checked since you are not expected to get an interview also. Am I missing something, however technically you should have a job when you get your GC and continue in it for some time.

Most ikely...Dreamers (misnomer but cleverly coined name) for half assed wall. I would bet the keyboard that I am typing that there is not going to be a damn thing for EB and I am perfectly fine with it. I benefited wildly by coming to this country and anything else on top of it like a GC is a bonus.

Yes Mexican Visa...and the worst thing si they only give out for a max of 6 months so took it a few times but its no big deal. Go to the consulate and chat with a guy and comeback and get visa stamped next day. I also found a work around for this which I am going to do next month. Mexico also allows people with Canada visa without Mexico visa so I am planning on getting a Canadian visitor visa which is typically given for 5-10 years and then use that to enter Mexico.

This is the most significant and priceless post I came across in recent times. I wish I was as courageous and pragmatic as you. So many of us chicken out because of secondary screening inspite of Having AP.

At least you will have no regrets...



Not sure if you are refering to the people on EAD or H1. I can understand people on H1 having reservations to travel to India due to uncertainty on H1 stamping etc but never noticed anyone on EAD having reservations to travel.

I am on EAD since 2012 and changed 2 employers since and traveled to India at least once a year for the past 13 years including the time on H1. I also started traveling to Mexico frequently in last 2 years, all on EAD and never once was i asked about whether I am even working or not in the secondary screening. Its a different matter that I never worked in EVC model, always a full time employee but that discussion didn't even come up during any of the secondary screenings at the port of entry. So I am puzzled why anybody on EAD would be cautious about traveling out of country.

Very very sad to hear.....with your PD even if you port to EB2 you have no chance of getting GC in at least 5 years as the law stands now. Kids in elementary school would be finishing college back in India in your family circle. I know you have thought through all this since you have good idea of the current immigration scenario .....wouldn't a TCS/CTS type company with working in India for a year and comeback on EB1C.

Topic: Strange RFE after employment based I-485 AOS interview

Technical answer is your previous employment has no bearing on 485, it should all be about your future employment. My feeling is they have strong suspicion on your current employer's ability. Instead of issuing a proper RFE with just the points applicable to your case, they just recycled some document that is used for H1B RFE. I think a good lawyer should be able to sort this out by working with USCIS. Its going to be long and some what expensive but should be ok at the end.

A very strong suggestion to all potential AOS/H1B candidates, if it isn't already clear is to avoid small desi consultancies like plague. Heck not just small but most all desi consultancies including the WIOTCHes. This administration has an axe to grind against them (I personally think they fully deserve this) and the employees who are caught in the cross fire (GC/H1 aspirants) are toast.

This thread seems practically dead due to the chaos in other parts of the immigration process. I am noticing in the CTS related threads that they stopped filing EB1C, and Aceman is mentioning that ROW demand is leveling off. With this in mind, are the chances of spill over going up this year.

The way it should have been all along....it disgusts me that so many H1s are used up by WITCHes for software testers and other low skilled jobs when people with critical skills in cutting edge technologies in companies like Google are denied. However it may not be long before the WITCHes and body shops find a new loop hole to exploit bt it sure is not going to be a walk in the parklike until now.
