I think they still accept the Visa /I-94 if they are valid. But just make sure of it before going to DMV else once the old DL is surrendered and if they don't give a new one , then one may have to call his/her friends for a ride and then onwards rides and rides......rides..... |

Guys!!! please advise!
My H1B already expired on July 04, 2008 and applied for H1B transfer and extention which is pending for RFE. I've driver license of FL (valid until June 2009) and moved to TX two months back. Am I eligible for getting TX driver license showing the H1B extention recept notice.
Please advise TX dwellers.

Not sure of TX but most of the states are not issuing the DL based on the h1b receipt. Did any one in this forum renewed the license based on the H1b Receipt Notice in any of the states? please share your experience. |

In US Driving(Car) is a necessity. A person is really a handicap with out a car/driving.

Hum...not exactly. If you are living in Manhattan,NY and driving a car to your work, then you will have to pay min $8 per hour (let me repeat it....PER HOUR) for parking. So, do you think that people who are living in Manhattan, NY without a car are handicapped?

How many cities in US are like New York ? I mean how many of them have good public transportation. I used to work in NY Mid Town and used to pay 10 dollars a day for Commute(as that's the way most people do it). If you live in such places instead of hadicapped, it will be something else..call what ever you want... 3. Yes, you are out of status. H1 without salary is considered as out of status. When your GC is in process, you can get away if it is 180 days or less using rule 245(k).
Here is an Attorney's reply:
- If out of status, is there any grace period? Legally, NO; Practically, YES - about a month.
H1B transfer without pay stubs is difficult but some got lucky.

So to maintain the status can a employee go back to his home country(say for about few months) and come back after certain time on the same H1 petition. |

[I need urgent information and help. I am in uS and got my H1B visa through 'desi' consultants this yr. These consultants have yet not provided me with H1B documents and say they will only give me I-797 at present and not I-129.
I have a couple of questions:
1. Can I apply for H1b transfer without the I 129 form?
2. They still have not arranged for any project for me. What can I do in case they do no find a project for me? I have not been given any pay stubs for this month. My H1B status is effective from Oct 1 2008.
3. If I do not get any project or pay stubs will I be out of status? If yes, after how many days from my effective H1b status date?
4. In case if my consultants do not find a job, should I change my status to a dependent (my previous status)

Giving salary in H1 is mandatory. DHS is strictly against benching on H1 so the employer could get in trouble. You are safe from that point. You can report to DHS about this if you feel you are being cheated OR if you face severe financial troubles.

worst thing is they ask for the valid H1 Petition and if you have filed for extension(which is obviously taking forever), one may not be able to extend his DL until he gets the petition. |

Bollywood movies does not portray the people's ways. Rajshri's,Yash Chopra's movies show that people are affluent and rich that does not mean whole country is rich and movies like salaam bombay shows people are in utter poverty that does not mean country is the poorest of all. ofcourse Bollywood hero jumps from one tall building to the other which is real Fake.
