The employer now refused to give dtails and I am not sure the consultant has given me correct reference no or has cheated me by giving some other aliens acknowledgement no from USCIS. When contacted he is treatening of filing case of defamation.
I am planning to give police complaint shortly and my lawyers are working on it. The local recruiter who handled my case now resigned from the consultant who claimed that my application was picked int he lottery.

Congradulations and wish you all the best. My case is still in RFE and my employer is not willing to send copy of RFE I tried in USCIS, Chennai today but of no use. They could not provide any details and they said i need to talk to my employer only.

My case is also similar to that of yours. I under stand maximum of 90 days will be given to the employer for replying to RFE. But exact nature and time limit only known to the employer. Many employer doesnot give details to the applicant like us. |

Hi Sridhar,
Can you please put some details for the following case.
The consultant claim that application has been selected and thrown in RFE on June 17,2008. The employer/consultant not giving details of RFE such as whether it relates to him or the alien. Even after 45 days no update for RFE in The USCIS website.
When pressurised for return of the deposit he says that since it is pending with USCIC for RFE even if USCIS rejects the application they will not return the check and no refund is possible. But when the offer was made, the offer letter clearly states in the event of the application being rejected for what so ever reasons, the consultant will refund the deposit.

Hi,
I also noticed in my case in USCIS web site stating a notice for Additional RFE has been sent .(I suppose to my employer who never bothered to update me, the RFE was dated June 17,2008.
Till date no update in the sebsite of USCIS or my employer. What is the time frame for filing a reply for RFE is it 30 days/45 days or unlimited period.
Can any one advise me.

I received my EAC receipt no from vermo and status shows as RFE as on 18.06.2008. I checked up with the employer who assured me that he take care. But till date no updation. What is the time granted by USCIS to file reply for RFE. How long the uscis take to approve the petition.

Hi,
We need to wait till july third week atleast. Till then need to keep our nerve. Only a very few might have received their papers from their employers. Those who were through consultant, need to wait. Till they received a beneficial project to place you .
Till then we can just assume and talk and it willbe a unclear picture only.

Hi Balaji Sai,
I checked up with my employer/consultant. It seems he is upset by my regular follow up throu mail and telephone. I promised that I will work with him as per the mutual agreement and he is relectunt to oblige. There is no formal contract signed. He says that he will take care to reply for RFE but till today he did not say to who the RFE refers is to me or to the him i.e. employer. He did not ask me any details even after ten days from the date of receipt of RFE mail USCIS.
I also requested that if he is not sure of success of the petition better return my deposit. He took it wrongly and said he may seek attorny.s advise to recover the amount from me. (filing charges) . I understand the pressure they may face but it doesnot mean they cannot be answerable to me.
What is your view on this. |
