If you don't want the comment period, their is a chance that this can be easily held in courts. If it goes through the rule making appeal can only be made in the DC circuit courts. Otherwise any judge can put a stay on the case. Look at H4 EAD vs. DAPA.

Also, if USCIS want to have a strong case they should have a 1 year wait period ( I am not advocating one), a lot of times Judges make decisions based on the intent of the law. AC21 gives the intent of the congress that wait time of more than 6 months is unacceptable.

Finally, politically we are all together whether we like it or not legal or illegal. If DAPA and DACA extended were implemented we would have all had EADs by now.

Not a Lawyer but my experience based on working with lawyers regarding Rule making with other federal agency.

You are only looking at once piece of that bill. The other piece was planned to eliminates the cap for MS students starting 2014 and eliminate per county limit as well. So >5years was only for the point based system to start in transition everyone would have been greened.

Any way this wont happen in 2016, most probably 2017. In the unlikely event that Republicans cannot choose a new speaker and Boehner remains as the speaker for the rest of the term, there is a slight chance.

Was reading this, if Greg can find anyone in this position he has an excellent case as he can prove the harm caused by such a decision.

Am I missing something here. This says they are trying to reduce some of the repetitive questions (burden) in I-140 form.

If DOL certified the Permanent Labor Certification, also submit a copy of Form I-797 Notice of Receipt for Form I-140 establishing that the Form I-140 was filed within 180 days of DOL certifying the Permanent Labor Certification;

Pure Speculation on my part...I think now that the courts have temporarily stopped the EA, can USCIS make employment based dates current to fund the staff hired to manage DACA and other programs until the courts decide.

To overcome the Veto it needs 66 votes...It would be hard for OBAMA if overwhelming democrats support the bill. I think it would be hard for OB to Veto the piecemeal on one hand and want some sort of reform.

Stop acting like cry babies...Most of them in this group want GCs it dosent matter if H4 EAD gets a work permit now they will eventually be in the work force. Its not a matter of if but when. Software industry has still significant room to grow, with the reforms in place many STEM students will start taking FT jobs in alternate fields and will reduce future supply. There might be an increased competition in some of the easy entry applications may lead to some pressure on wages but not significant as you all are describing.

Step 3: Preparation of Proposed Rule
Step 4: OMB Review of Proposed Rule
Step 5: Publication of Proposed Rule
Step 6: Public Comments(usually 60 Days)
Step 7: Preparation of Final Rule, Interim Final Rule or Direct Final Rule
Step 8: OMB Review of Final Rule, Interim Final Rule or Direct Final Rule
Step 9: Publication of Final Rule, Interim Final Rule or Direct Final Rule

If the intent is right this should not take more than 6 months
