AOS Interview:  Cleared   (0 comments

Interview Notice Issued: Interview Notice Received:
Interview Date: 05 Mar 2008 Interview Location: Newark, NJ
Interview Status: cleared Nationality: India
Interview Experience: Hi,

Im the primary applicant and my wife was the derivative.

The officer had loads of question for me. She went on asking for things that were 8 to 10 years old, my company's clients (which I couldnt recall). I felt most of the officer's questions were a bit ambitious, officer wasn't very specific. Initially I thought I was nervous and stumbling. After few questions, I realized the questions were in fact confusion.

My wife had a bit of tough time as well. She is currently on training in London, and visits me every month for a week to two. Apparently, the officer didn't like that and the there were lot of arguments from our side (including my attorney). At the end she basically shut us by saying we are unable to establish the spouse doesn't reside with her husband and that she is going to move the file to her supervisor for the review.

It got concluded with the officer requesting a review by senior/supervisor and we wait until we hear from them. It's been two weeks now and no LUDS nor RFE.

Also, the dates aren't current for EB3 (my PD is July 2002), we just have to wait and see if they are going to request anything.

Hope not hearing from them means good. SO, I have set the interview status as cleared.

Thanks!

Topic: What happens to status after successfule interview

tzs3k,

Yes, there is no change after my AOS interview. The only LUD was when they sent me the letter for the AOS interview.

Topic: What does "Sec 245 pending" mean?

Thanks very much for the quick reply.

Yes, my 485 (I guess it's AOS) is pending.

The officer wrote this in my passport after the interview, she also handed over a sheet (doesn't have any name or number to tell what the sheet is). One of the lines says "You have 30 days to comply with the following or the case will be denied"

Hi,

In my AOS interview, the officer scribbled

New 3/5/2008
Sec 245 pending
A#

What does sec 245 pending mean?

Thanks!

Topic: What happens to status after successfule interview

I completed my AOS interview on March 5th, 2007.

1) The officer took our i-94.
2) Scribbled (new 3/5/2008, Sec 245 pending and EAD number). I had to look hard to read why the officer wrote on the passport.
3) A printout (I can't seem to find a name or form number). One of the lines reads...

You have 30 days to comply with the following or the case will be denied.
The officer striked out 30 and wrote 0.

I expected a LUD, but no change.

BTW: Does anyone know what is Sec. 245 pending?

Topic: AP Travel - JFK or EWR ?

cd0811,

2 to 4 weeks vacation is seems ok. If one goes for three months, the officer may find it strange; it can draw anyone's curiosity.

My trips outside range from 3 days I was in UK for 7 weeks, I had no strong questions asked. In one occasion, the officer was surprised and felt sorry that it’s taking this long for my green card.

Allow me to give you a piece of advice if you don’t mind. Be diligent, and STOP worrying. You are going to visit your country after 7 years, have a good time.

Topic: EAD validity period

My first EAD was valid for a year. The second one, which I renewed this October is valid for 2 years.

RockyRock!

Here is what I do...

1) Pick the airport closest to my place.
2) There is nothing to fear.

Just so that you are aware, here is what happens while you enter immigration.

1) Officer sees that you're entering in AP. He may scan your index finder.
2) He will put your papers in a special folder and ask you to follow him to another room.
3) You will be asked to take a seat and asked wait until your name is called. It feels odd when you are taken to another room (stay like a rock and don't panic)
4) After few minutes, you will be called to one of the counters.
5) The officer will enter some data into the system, and MAY ask some SILLY question(s).
6) In few minutes, you are done and on your way home.

I have traveled on AP 4 times since last November, my wife traveled at least 6 times since a year. I return to Newark as it's closer to my place.

Topic: LAID OFF - PLEASE HELP !!!!

TheProdigy,

When will your application get an approval?
EB3 for Bulgaria is 01MAY05. You should get it soon. I’d give it 6 months before I get worried.

Look for another job, stop worrying man. Go do something you always though you’d do when you were a kid.

JUST MAKE SURE YOUR EMPLOYER DOES NOT CANCEL I-140. I would certainly invoke ACT-21 the minute I get another job. You never know.

Topic: LAID OFF - PLEASE HELP !!!!

1) If you're called for AOS interview, you'll need to have a job at that time. Also, employment letter, tax returns for 3/5 years, education certificates, etc.
2) Should you get an RFE, you got to have the job to answer any evidence.
3) If you don't get called for AOS interview and no RFE, you are fine.
4) Your PD is far down the line, this could mean good for you. In that I mean, you will have enough time before 1 or 2.

I assume you are going to India to go away from your work. You don't want to be running to the Consulate back and forth. I would rather get it done here. Just my approach.
