I feel sorry for your situation. Yes, as mentioned, you need to take a break. Try all options like infopass, email to ombudsman, call USCIS and request them for the approval. I know it's difficult as the first thing they ask is if it crossed 90 days since applied.

Call that number after 90 days and request them to expedite. They did in my case. I also made follow-up calls 3 to 4 times in next 10 days. Email ombudsman as well. If you have the local office, nothing wrong in taking infopas appointment a week ahead. If the agent says you need to take infopasss , ask if he/she could instead expedite the request citing some valid reasons. You could also mention that these days we don't get interim EADs at local offices.
You can opt for for "Financial loss" or "Humanitarian gorund" if expedite is accepted as you'll be asked under which category the expedite falls.

Topic: Am i in really bad shape? Please help me out.

Here is my situation

1. My EAD expired yesterday. => OK, Apply for renewal.. better to have it handly for future use
2. I have valid h1b till next year may. I have expired visa in passport. => OK
3. I used my 131 AP to go out and come in. => OK
4. I did not use my EAD or AC21. Working with the same employer. => GOOD
5. My i94 at port of entry issues till the validity of my AP(i.e jan 30 the 2009) not with the h1b (may 09) => You better apply for extension of H1B before you reach the parolled until date though the H1B petition is valid till May 2009. Check with a different attorney than the one you have.

My attarny says i need to stop working till i get new EAD, which may take 90 days. Here are my questions.

1. When i travel on my AP, does it mean that My h1b is in validated and I am working on EAD. => NO
2. Do i need to take off from work till i get my next ead? => Not required. You are still on H1 status
3. Can i work on my h1b? if yes till when (may 09 or till my i94 expiration i.e jan 30) => Check with good lawer and apply for extension accordingly
4. Can I apply for h1b extention for 3 years based on my approved 140? ir is it too early as it expires after 7 months.
=> If you have to apply as per parolled date, you can apply for 3 years extension. If not, wait till next summer and applly.

Buzzy,
I think the status shows up little later. Here's what happened to my case.
EAD was approved on 10/15. No status change till till 10/21. I called up Texas SC and the agent escalated to another officer who said that it was approved on 10/15. I asked him couple of times that nothing was shown up online. he said that was normal. Status changed to "Approval notice sent" on the morning of 10/21. Card received on 10/22 evening which means that was dispatched much earlier.
I suggest to call Customer service and ask about the status. I should be fine. Good luck!

I think it'll be delivered tomorrow. I'd a similar experience and it was delivered the next day. Ofcourse, assuming that was the right address you were supposed to send. Good luck!!

You can ask the agent to expidite the case when you call them again, Email ombudsman (Ther's another thread on how to email). Also, as mentioned in this thread, try infopass and see what they say. Good luck!!

Topic: It seems CPO after > 100 days

Well, my EAD Efile extension was filed to TSC, it's been 104 days since then. Here's what I did.
- Called up USCIS on 10/06 => Requested to Expedite
- Called up USCIS 10/14 twice again => Heard the response for the expidite is on the way
- Send email to Ombudsman on 10/15 => Got ack email on 10/15 saying the office would lookinto and to contact them after a week if still not heard of the result
- Got the postal mail to expidite request from USCIS on 10/17 that the case is being looked into
- Called USCIS on 10/20 and the agent escalated to the highr officer who took the A# and said the card production ordered on 10/15 for 2 years till Oct 2010 and should be on it's way anytime. I asked the status is not reflected on uscis website and he said, their internal system shows the status and not always it's updated in USCIS site.

My question is: did any of you face a similar situation where in the officer says CPO but you don't see that as actual status or you have received the card but the status shows pending. I'll update this thread as soon as I see the staus changed or when I get the card in mail
