Technically, you will be one *after* you move back. For now, you are just intending to, which is always subject to change. :-)

Good point :)

Topic: Life in India now and before...

People

Do you think that once you return to India, you will not miss USA? Then you will start the reverse r2i dilemma -- should I stay in India or return to US? That will waste at least two years of your time, money, and focus in career.

You have to know what you want out of life, otherwise you will never be satisfied no matter where you live.

Topic: Reasonable Attorney

I have spoken with Dimo on the phone, he is very good. Go to lawbench.com and you'll see Dimitar Michailov's name there, he calls himself Dimo on his website http://www.cilawgroup.com/professionals/ - and yes he's in DC.

Topic: Steps to be Taken once after receiving Green Card

- Yes, have your employer photocopy your green card. You will need to fill out a form as well, I think.
- You can also apply for a new SSN card that will have the "work authorization" part corrected from your SSN card. Your SSN remains the same. This is an unimportant step. You don't have to do it.
- Also, keep record of your last paystubs etc in case you quit your employer.

Topic: I 485 - AOS and Time out of Country

You can stay out for 1 year at most, without filing for re-entry permit. AP is also typically valid for 1 year only.

Check out Andrew Wilson or Dimitar Michailov. I have interacted with both of them on lawbench site, they 're top notch and very thorough.

Dont get depressed guys, this is life, things happen.

I recently lost my wife @ the Holiday inn , honululu, Hawaii. For a minute i thought that my life was about to end. & the future
looked gloom, Then suddenly i saw my wife coming (sneaking rather)out of a white guys room , Boy was I glad to find her !

Now looking back , i feel assanine about how depressed I was, she was perfectly fine in somebody elses suite.

Topic: Leave US and come back in pending I485

I don't see any problem as long as you have either a valid H-1 visa stamp in your passport or a valid AP on return.

Topic: Earning extra money on H1b

Thank you geeGC. I agree that I need to pay taxes on that....but the only question will that affect to my current status.
Do we allow to earn extra while we are on H1b?

Dude, take a chill pill. Why are you so god-damn worried about this issue?

The answer to your question is obviously that you cannot work actively outside of your H-1 sponsoring employer. But do you think all the people waiting for their GCs for years are not doing anything on the side? Give me a break. I know so many people who run websites or make small money on h1 visas, like photography, writing articles for magazines, etc. Take it easy.

I don't see any problem. IRS and INS don't talk to each other :)

Topic: I have an urgent question...

I have serious doubts you can claim unemployment without a green card, even if AOS is pending for 180+ days.

May be a good idea to post your case details on trackitt.

Topic: Ron Gotcher or Bill Bannett

Saying lawyer X is better than lawyer Y is nonsense. You cannot compare lawyers on an absolute scale. Depends on what you are looking for. Is your case employment-based, family-based, litigation related, deportation related, asylum related, or what. Different lawyers develop expertise over different areas of law as they gain experience from working on their client cases.

So what exactly are you looking for in an immigration lawyer. Then go talk to multiple lawyers about the recent cases they have filed. Ask for references, etc. Selecting a lawyer is not just black and white.

Also, it's best to select an attorney whose practice is 100% immigration law. I would never select an immigration lawyer who does personal injury 30%, criminal 30%, and immigration 40%. One lawyer simply cannot do justice to immigration law practice by devoting his time to so many legal areas.

Topic: Lay offs coming at my firm ...... need some inputs

I think dvd recommended a change of attorney to avoid conflict of interest. The attorney who did the EAD was hired by the company, so the lawyer has a responsibility to the company, not to you. After layoff, you will need a lawyer who represents "you".

Topic: Life of an immigrant in America!

yes, reminded me of office space.

Boss: Peter, you missed office on sunday.
Peter: I... didn't exactly miss it!

The parking lot one is not related to immigrants I think, but I still like it, it's quite funny. There's a couple making out in the car while the guy is waiting for their parking space.

Topic: Life of an immigrant in America!

I like the one where the guy is depressed because his "non indian" friends made lot of money investing in indian real estate :)) LOL...

The one with the boss asking the guy to stay till 11pm is also funny I thought, typical of some managers.
