I do not have visibility into the process of extending the EAD based on the new H1B. I will worry about it, once I get closer to the EAD expiration date. I would think that you would reapply for the EAD with the updated documents. This would mean that you would have to pay the fees again and do the whole process again. I would probably reapply for the EAD 3 months before the expiration of the current EAD

1) No
2) Not because you changed jobs. As long as you have a valid H1B at the time of filing, and an approved I140, you are good
3) As long as you are on a valid H1B status, your spouse is eligible for an EAD. ( of cos 140 has to be approved)

A few months ago, I went through a very turbulent set of events. I have an approved I140 since Jan 2014. In May 2015, my company got acquired and we were all laid off. I was able to find a job a week before the actual lay off happened. However, my new company's lawyers moved very slowly and only got ready to file my H1B petition in Mid July. As i was not employed at the time of filing, they filed a consular petition and I had to leave India in the middle of July. Since I was applying back as an H1B and I had an H1B before, I was able to use the drop off facility. There was no interview. I am back in the US and in my new role. There were no hiccups in the process, only the stress of what if something went wrong.


During this time, we applied for my wife's H4 EAD on May 27th, 2015. We got an RFE on July 1st as the photographs I had sent some how got damaged. I had to respond back before September 1. I sent them the photographs before we left for India. While we were in India, her H4 EAD got approved and got shipped. When we came back, our H4 EAD was in our mail box. A good feeling.

On the H4 EAD front, the lesson that I learnt was that at the time of filing, as long as you have an I140 and a valid H1B, you will get the H4 EAD. It would be good if you do not leave the country as they may send you an RFE,

I hope this de-stresses some of you who are in a similar circumstance.

In the filter options for the H4 EAD tracker, there are 7 service center options while there are only two possible filing stations (dallas or phoenix). How do you know that once submitted, which service station is processing your form?

Congratulations to every one in this group and especially to those few optimists who never gave up!!! This shows that that with the right technique and right people, we can bring about a change.
This is going to be huge. This is going to have positive repercussions in the market and improve lives of all those families who wish to have a second income!!

We need to put a face to this problem. All those on H4 and on this group, can some one make a video detailing the challenges for a H4 visa holder? If it is made, we all can make an honest effort to have it circulated on the web.

I second that idea. However, we should not only limit ourselves to EB categories but also include FB categories. Indians and Chinese face genuine discrimination due to the current US immigration policy in all the immigration categories. If they are equally qualified if not more than their counterparts from the ROW category then why are they being penalized for being born there.

I think, we have a struggle on our hands and we need to show the people, our side of the story. As legal immigrants, we may have more tools at our disposal, then we think. We need to form a genuine protest like the illegals and show our worth in the American society.

The timing of this email confirms that something is definitely brewing there... and we will hear from BO anytime now. Even though BO has announced EO on immigration, his reply still say " That is why I am deeply committed to working with Congress to enact bipartisan, commonsense reform that fixes our broken immigration system and delivers relief for those in need" which some how seems confusing at this point.
