Topic: I765 EAD card returned and eplilogue

This post really helped me. My wife tried infopass, calling USCIS multiple times but no result and they all gave standard answers. Finally, using this post, my wife faxed the letter and within an hour she received call from USCIS and the EAD was on its way within a week. Great post and great job by USCIS fax processing department!

Topic: AC21 EVL question

This is nothing to be scared about. You can discuss with your new employer that this is the only way where you can safe transition. They will understabd it. If you cant convey this point to them, they will be no better than your current employer.

I sent AC21 letter signed by my new employer and I believe that is better practice to avoid possible RFEs (cant gauranatee though).

I do not agree with the logic. However I agree that it will be years before everyone get thier GC who applied in July 07 fiasco.

I read from posts it happens and If you dont receieve in a month then you can call USCIS. Check other posts to be sure.

Also, Why dont you update the profile with your case information. It will help members of the forum to estimate timelines.

I guess the H1 cap was increased to 190K from 60K around 2000 and too many people applied for GC in 2001. And slow processing on USCIS resulted visa number loss.

PD: 1999? Holy ....? Your GC will be more faster than getting H1 visa stamping appointment. I should have looked around too. I lamely wasted 5 years so far.

Topic: Any predictions on Jan Visa Bulletin ?

Labor for years, I-140 for months, keep up to date with H1, wait for Visa bulletin to apply AOS, No FP for some more months, Wait for visa bulletin for few more months, Wait for Name check for years again, Some other checks, Sometimes start from beginning and other times start from last process, the road is never ending for more than hundreds and thousands of technology people. Well, spending hours, weeks, months and years on immigration sites, I'm more an immigration consultant than technical consultant =)).

Call up our local congressmen and ask them to look into your case and explain them the situation. Ask them to vote for pro-legal-limmigration bills. This is the process in US just as we in India have process of MLA recommendation, MP recommendation, etc. Here it is perfectly legal to do so.

Alternatively, you can do many things in US without GC. You can attend school, do voluntary participation, invest in stocks, etc. I dont want to be cynical, but if you are frustrated for GC then you will be frustrated after GC.

EB3 from India typical wait period is 5+ years, so you can still save your future investment and can apply for EB2, EB1 or look for better opportunities.

This is just my opinion and please contact a attorney for advise.
