Topic: RFE Response Deadline
Meanwhile, unless USCIS told you clearly to send originals, they take copies of fax, printout of scanned images etc. I did not send any originals and my case was approved recently.
This is correct. I did need documents from India as well. I asked my family to send me a scanned copy which I then printed and sent to USCIS. I received the originals later and just kept them in case it was needed.
It is really important to have the documents received on time at USCIS. It is possible that they may accept it a day late or so but I would think that it is risky to do so. |
Topic: Birth affidavits - Originals or Photocopy?
In my case when filing the I485, I only sent in copies of the affidavit. I applied during the infamous July/August rush last year. There was not enough time for my family to mail me the affidavits in time from India. They sent me a scanned copy which I attached with my I485. My attorney said to hold on to the originals in case I got an RFE. |

Good luck...
Assuming that you have 30 days to respond, maybe you can come back sooner if needed. |

One thousand dollars is indeed a lot of money but I am sorry to say this that a denial of the I-485 will be more
expensive.
Yes, I got the RFE letter as well as the original medical form I-693 in a sealed envelope. This sealed envelope must
be opened by the Civil Surgeon only.
It's up to you. If it were me I would wait for the RFE. Do as it says. Respond on time and then
travel with peace of mind. |

You are welcome.
My physician did not do the TB skin test. Just the X-ray.
For the RFE, USCIS sent back the original medical exam in a sealed envelope which should only be opened by a civil surgeon. The civil surgeon did the TB test again and recorded the results on the old form and then I sent it back.
If both you and your wife had identical medical exams then this would not be an issue for you. In my case
both my wife and I had gone to different civil surgeons for the medical exam.
You could ask your attorney to scan and email the RFE to you. That way you may be able to get started on the documentation.
If it were me I would delay travel if possible until I receive the actual RFE. |

Congratulations on your GC ...
It takes about 6-10 days to actually receive the RFE. Unfortunately the IO's will not be able
to tell you what it contains. You have to wait for the physical mail to arrive.
Furthermore, you have to attach the coversheet of the RFE letter to your RFE response. The
coversheet contains a barcode and other information that allows the USCIS Service Center
to route the RFE response back to the adjudicating officer. This means that you cannot
respond to the RFE without receiving the actual RFE from USCIS.
In addition, you are allowed about 30 days for the response to be sent back. If you do not
then the case can be denied.
For your benefit I am attaching my RFE timeline below:
06/06/2008 : RFE email sent
06/16/2008 : RFE received by attorney (postmarked on 06/11/2008) for TB skin test
06/20/2008 : Send response by Fedex
06/23/2008 : Received by USCIS; case resumes processing
06/30/2008 : Approved
07/10/2008 : Received card
As you can see it took about 1 month for the card to be approved after the RFE was issued.
This appears to be fairly typical. |
Topic: H 1B cap exempt to Greencard
I have a cap-exempt H1-B through a non-profit research organization (affiliated with a university) and got my GC recently. |
Topic: how many times every one check on line status
In June, I used to easily login to the USCIS website at least 10-20 times a day. I got approved recently so I don't think that they "lock" your application for checking status too many times. This opinion is based on the statistically insignificant sample size of ONE (my case), so take it with the appropriate grains of salt ;) |
