I was told the job description that we have in our company will not match with the "software developers" category which is why all SDETs are put in this.

I gathered from lawyers that my JD doesn't appear to be speciality occupation that it may not require a bachelors degree. Not sure if USCIS thinks developers without bachelor degree can replace SDETs with Nodejs experience. The response from my lawyers is going to be a EO letter along with similar job Ads that indicate my role does require a college degree. Has anyone encountered a situation of this sort ?

It does ring a bell that my employer laid off about 40% of its workforce last year in this very location. I was one among them until I decided to move to a new team in the last minute. Those jobs were simply moved to India. Wondering if that could be the reason. May be not here but I sense danger in having my extension processed in few months.

Hello guys, I'm trying to speculate what could have triggered an RFE from USCIS for my H1B amendment after my immigration team decided to file one due to change of title with same employer and location. I have been working with in organization for about 4 years with a I-140 approved a year ago. I don't think the lawyers would disclose what the problem is, but I was told to refactor the JD and send snapshots of the product I'm working on which is a cutting edge AR technology.
Can anyone speculate what could be the reason ?

Looks like you've been since 2013 and haven't you understood why 4 would likely not happen ?
A judge can't rule out overnight and make all H4EAD'ers work illegal. A rule making should be the reasonable action and it has its own 2-4 year life cycle. If you are closely following IV you should remember that need people like you to fund them so they keep faking stories such as defending H4EAD or even H1B in future.Most of the veteran users here have lived their life listening to BS from IV.
If H4EAD has to be gone it would have vanished without a trace in 2015. Does your admin have an answer for this ?

It wouldn't surprise me if they extend it for another 6 month beyond Sept to keep the panic up and running between indians followed by another 6 and ever. If you're worried about options, I would go back to India or move to a different country.

Is there a statement legalized anywhere which says H4EAD rule is going away instead of IV being "dead sure" about it ? The President could have voided this rule with just an EO but they wanted to run behind Save Jobs USA for a reason - to amend with a new rule.
You must know why IV does this just to keep their engine running, brother !

Note there is a reason why trackitt experts haven't commented this post yet because this is not realistic but just phobic.

Yes you can. There is no restriction with your employment with or without middleman in an EAD.
I assume you know how to file your 1099 to IRS in such a case.

Probably, but I'm not sure if I should show the compelling circumstance during renewal as well. This would be a pain in the back by writing letters every 6 months anticipating a hit-n-miss result.

1. Not necessary unless you want to avoid stamping next time you go to india before Oct 2018.
2. They won't restrict your entry even if you have a day left on your visa. My wife reentered to the US when she had about a month left in her visa.

I'm trying to understand if a layoff can be used as "compelling circumstance" to apply for I-140 EAD since it does cause disruption to employment without notice. Let's assume the employee did not find another job within the 60 day period. Can anyone post your opinion ?

I'm looking to hear from someone who switched jobs after I-140 being approved 6 months later. Were you able to verify if old I-140 wasn't revoked by USCIS according to the new rule in Jan 2017 ? Were you able to renew your spouse's EAD with that ?
