Topic: need guidance with immigration

I would advise your friend to try for Canada. It is SO much more immigrant-friendly and plus it seems like health care would be very important for you. Which def makes Canada a much better choice. You can become a citizen about 3 years after you get there. If at that point, your friend still wants to settle in US, it will be easier and then at least she will have something to fall back on, i.e. canadian citizenship.

Topic: Can PD of 2003 be bypassed??

hey all - I am trying to keep my mind off this possibility but I can't help myself.

My Priority Date is quite old – March 2003. The current visa bulletin has a processing date of 2005. Deos this mean that anyone with a PD later than mine but who falls into the current 140 and 485 processing dates, could (and probably will) get their green card before me? My 140 and 485 went in with July fiasco last year but somehow got a "USCIS received date" in Sep.

Even worse, could the CIS fill up the fiscal year quota for my particular category (EB3) with 2004 and 2005 people so that I could be left out yet again and made to wait for one more fiscal year....??

Anyone got any ideas??

btw why do you think they asked for the ownership info of the company and whether you have any relation to the owners ??



They want to make sure that people are not trying to bring their family here using employer based visa's. So say one man opens a consulting firm here. He wants his bro to move here too. So instead of applying via Family based category (which I understand is in an even worse state than EB), he hires his bro and tries to get him green card that way.

At least - that is what I deduced from years and years and years and years of reading these blogs.

Disclaimer - I am NOT a lawyer so don't take anything I say as gospel. Having said that, I honestly think I know more than my lawyer. He's clueless. I could surf the net and get better answers.

I thought that namecheck did not matter so much any more if your application had been pending for more than 6 months. That is, they will still do it (and can revoke your green card if they find something out later) but name check can no longer hold up approval of 140/485 apps...??

I'm sorry - what exactly are you trying to point out here...? There was a bunch of different links on the site you pasted...and none seemed to be about Green Cards (just H1, EAD etc).
