MTR denied and case transferred to AAO. All the time and money is lost with full of tensions. Anyways I am planning to start with a new labor. Good Luck to all others who are still fighting with MTR's

Topic: H1B extension stamping, I40 RFE, pending

Already got H1 extension based on Labor approval...so even if he wait for 140 approval he cannot extend H1 for three years as he already has one valid. And regrading the RFE, it is completely dependant on case to case. Mine took 7 months to get reply.

So I wish you can go ahead and attend for stamping and wish you good luck.

Hi MyGC77,

You can go and attend for stamping if you have valid I-797. I had the same situation, after submitting my 140 RFE, i went to India and got my visa stamped (provided you have all the required docs)

It is better to get H1 stamping in India.If you have H1 stamping you don't need to wait in India for reconsidering your case.We have got the same situation and we did the stamping in India.Hope this is useful for you.
