This is not true, there is no special tax treatment for a bonus in US. They get added to your normal taxable income. ADP software in your firm might take off 40% because of a sudden increase in salary for the bonus month, but then adjust later.

For public knowledge, i was able to get my Schengen visa stamped in the Spain NYC Consulate . They do not have H1B specific expiry requirements and they only require a valid stamped H1B visa until your return date.

Seems you have similar plan, would you be able give your feedback on these? Hard to get through the phone system.

I am flying into Barcelona and flying out of Paris. So don't really have a round-trip from the same airport. Did you show train bookings in between Schengen cities?
Spain consulate says appointments 3 months in advance (I assume this is 3 months before planned travel "start" date)
I am travelling with my wife, but had to take different appointments. Do you know if the consulate allows family to appear together?

I am travelling to Spain and France in July. (14th to 29th) My H1B expires on Sept 28th. French consulate needs H1B validity for 3 months (along with passport validity) requirement. Spain consulate seems to have only passport validity requirement.

Has anyone successfully got Schengen visa (in any Europian consulate) with H1B validity less than 3 months?

Hello Folks,

I understand similar question has been asked before but couldn't find a concrete answer. I have been working with my current employer since mid 2010 and it was taken over by another during this time. The old employer (M) is a still valid legal entity and operates as one owned by the new (B)

All my previous I797 and even my I140 has the old employer (M) and I used to always write M as my employer althought all my paystubs and employment verification was supported by the new (B)

I made an internal move last year and now for this H1 stamping I have B as my petitioner

My question is should I write M as my previous employer in DS160 (although I haven't really changed my job) since my current I797 has B as the petitioner instead of M (as on all previous I797s)

Topic: H1 Dropbox mandatory?

Folks, not sure if it is an option to not do drop-box but do interview instead. I am travelling to India in Sept and plan a vacation in south east Asia from there. Even if I drop off my passport on 3rd, I am not sure if there is a real guarrenty that I will get it in hand by 15th when I travel. I need my passport for my vacation. If I go for in person interview, at least I will get my passport in time.

Is there such an option?

Say your net worth is 500K. Annual earnings 100K. You have Umbrella coverage of 1MM. You hit some from rear and hurt his back. He claims 5MM. GEICO says there is no point in fighting as the judgement will be easily more than 1MM so GEICO agrees to pay upto 1MM and washes their hands. Now you are left to pay the remainder. What do you think is going to happen to your 500K assets (only those that are not protected like 401K, IRA etc) and a portion of your future earnings. You will loose all those.

Guess 1MM would be 150ish and 4MM would be 550ish. Depends on a lot of things.

OP needs to hire a good lawyer to fight his case ASAP. Discussing this on Trackitt is (I guess) a waste of time for him at this point.

I have GEICO Umbrella. My limit on umbrella is more than 1MM. Yes 300/300 is minimum. 1MM Vs 4MM would cost you extra $1 a day. You might have 1MM assets but that does not mean that 1MM umbrella is sufficient. E.g. if you hit someboday from rear and hurt his back, you can get easily sued for more than 1MM and if a judgement is pass you are responsible to pay everything above 1MM. The point here is if you buy 4MM from GEICO as an example they will hire best of the best lawyers to settle it for much less leaving you unexposed. That's how I see it.

Please note that your retirement assets like 401K (IRA and ROTH IRA depending on what state you reside in) are protected in full in case of personal liability claims. I think there is a limit upto which your future earnings can be taken out. I dont think any assets that belong to your wife / kids can be claimed as well. That leaves your house (again your share of the house typically 50% if you are married depedning on state laws) and your personal and investment accounts and portion of your future earnings exposed to a lawsuit. Please hire an experianced attorney who can fight these kind of lawsuits. This is NOT the forum to look for that.

Looks like I turned the "CIR" thread itto "SAP" thread. One can not compare salary with consultants take home rate. A salary has added benefits that are not accounted in the numbers like 401K / Pension, Health Insurance contribution, Paid Vacation, Other insurance benefits, free / discounted childcare and company benefits and matching programs. There is annual bonus (that is typically 15-20% in a good group even in these bad times).

Btw, I have just turned 30 and very happy with my professional and personal life in US. Ha, I don't have 2 hour commute and do not spend more than 100 bucks on it. lol.

All I wanted to say to imtired was US values meritocracy and risk taking and that is why we all are here. We can not entirly blame lack of GC or CIR for our professional life. I agree that it restricts our abilities but then there are many things that do.

Don't have any specific skill. I work in IT Product Management in an investment bank. My job involves sitting side by side of trading / sales desks to understand technology needs / opportunities. I then work with different technology teams to make stuff happen.

I don't mean to put you on the spot but this problem is problem of not taking calculated risks. I started at a salary of 95K after my MS and 5 years from now making close to 150K. I jumped twice and still have my approved I140 in hand. Again I think it is less for the work I do as I had to turn down an offer last month close to 180K due to the fact that new employer is not willing to start GC process from Day1. I will watch how the reform goes else will take the plunge. US does reward education and risk.

Topic: Lower tuition for illegal immigrant students

I came to this country on F1 visa. Had an admit from a top 5 private school but chose to study at a public university with full scholarship and a part time job. Public universities charge out of state tuition on F1 but there are abundant resources they provide to international students in terms of on campus jobs, RA, TA and CPT to help them with their tuition. Private schools on other hand charge same tuition to residents and F1s.

While I do not support benefits to Illegals without any benefits to Legals first, this one is not really about the Central Government or Obama.

Each state has different rules for In Sate tuition and many states like TX, NY and CA give instate tuition to H4, L1 and L2 visa holders who want to pursue full time studies.

State universities are funded by state and they can dictate what to do, not the President.

-Not doing a Project and not getting Paid (Mostly consulting companies)
-Getting "Per Diem" income that is not reported

These are some activities I think are Illegal on H1B. While I understand that people have to do things like this in certain extreme scenarios. Life is hard and people have to make difficult unethical choices. But when people say "Illegal=People Crossing Borders" and those are "Bad" people, we have to understand that those bad people might have made this choice because of extreme difficulties that they might be facing.

Disclaimer: I have not crossed any borders. not done any illegal activity. Done my MS and joined a US firm. I am Indian national in EB2 category :) [poor Me ;)]

I hope so. I do not agree to the fact that Illegals should get higher priority over Legals. However one should not consider Illegal = Someone who crossed the border illegally. Anyone who has done Illegal stuff (even while on H1B) is an Illegal in my eyes. It is for the government to decide what is the definition of "Illegal".

That is anybody's guess. Honestly, I do not know what will happen to the rule. I know this has been put forward couple of times. May be this will get some attention this year due to in general focus on immigration. I am keeping my fingers crossed and suggest you do that to :)
