Topic: From F1 to H1b while I have pending I-485


If you have applied for I-485 , it is not advisable to leave the country without Advance Parole , if you leave the country without AP , your I-485 will be deemed abandoned , so please do not even think about travelling without your advance parole

In order to apply for H1b you DO NOT HAVE TO withdraw ur I-485

Thanks so much, but I read that having H1b secures the pending I-485. Isn't this correct?

I am an F1. I married to a US citizen and applied recently for AOS, Advance Parole and EAD. My sister is getting married this summer (July 17) and I do not think that I will have my Advance Parole by then since I am still waiting for a receipt number.

Since I will start working as an adjunct in august for in my husband's university, an attorney advised me to apply for H1B.

My questions are:
1) If that university accepts to sponsor me can I apply to H1B while I am in a pending AOS, which I applied being an F1?
2) Would my I-485 application get annuled when I am re-entering the US?

I am an F1 and I applied for AOS, EAD and AP. But I am afraid that I will not get the AP on time to travel to my country to attned my sister's wedding. So an attorney suggested that I can apply for H1b since I will be working in my husband's university as an adjunct instructor next year.

My questions are:
1. If I appy for H1b now, after filing my I-485, will my I-485 be cancelled?
2. In order to be able to appy for H1b should I withdraw my I-485?
3. Can I travel to my country and come back without any problems on H1b while my I-485 is pending?

Hi,
I filed an AP concurrently with I-485 and I-765. I know that my file is received on 7th April 2008. Do you have an idea as to how long it will take for me to get a receipt number and my AP?
