yes... weirdly even though he has recieved his green card already...he is also getting the same notices as me...got a msg saying his case got transferred to NBC and now his status is also the same as mine.. but we are more concerned what this new msg means? have they decided that we don't need to come for an interview cause it's a simple Employment based case and my husband is the primary . |

can someone pls. explain what could be going on with our case.
my husband got his GC approved beginning May. i on H-4 got an RFE ....for legal status when i first entered on H4. we sent what we had . the website then said our case has been sent to NBC for an interview. that was 2 weeks ago. today the msg on the website says " This case is now pending at the office to which it was transferred.
The I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS was transferred and is now pending standard processing at a USCIS office
what does this mean? will we not get an interview finally or has it been transferred to a local office but then why don't they specify which office it's been sent to? what can we expect next? |

which state congressman/ senator can help me and where can i find the tel nos.

yes our time in question is from the time i first entered on H 4 May 2003 so i wouldn't have an I-94 card...till Oct 2004. in this time period i went out of the country twice so i would have two I-94's . we don't have those copies. but i have a visa stamp that clearly says H-4 visa which we got in india after we got married.
no status changes during that time period at all. my husband's 6 yrs on H 1 end in Oct 2004 and we got on the yearly extensions after that.
attorney is not sure what's going on and the oddest thing is my husband also got an interview call AFTER recieving his green card already. so we are very worried !
we did realise that our lawyer made an error on the I-485 application in saying that i never had a criminal case. i had one case from 8 yrs ago when i was here as a student on an I 20...but the case was dismissed. we are gathering all info. on the case as well to be safe.
my question to you is , do you think an interview is because of a case pending and i have heard they always call for an interview when there is a criminal blob on your record. or is the interview because our RFE info. we submitted not enough.
does an interview call after RFE info. is submitted usually mean that they need more info. on the same issue as the RFE or could it be something else all together? |

hi prasad, my husband and i submitted our I-485 and he got his green card but i got an RFE for the same thing...prove lawful presence in the country from the first time i entered the US on H4 till one yr later. we did not have old copies of my I-94 so we sent a clear photocopy of my passport with the H-4 stamp and the visa stamp. But then i got a msg a few days later ...case transferred to National Benefits Center and will be called for an interview. we are extremely tense. anyone who has any suggestions or help it would be really beneficial. we are loosing sleep over this ! |

this we found odd as i clearly have an H4 stamp on my passport. we sent them a photocopy of the visa page and my entry stamp as we could not locate I-94's from that period.
now my case has been transferred to National Benefits Center for an interview. and suddenly oddly enough my husband who already has his green card has also been called for an interview. we are extremely confused. any ideas? thoughts? |
