Less than 180 days is critical and attorney can defend you with 245k rule. One thing you might want to check with attorney is if USCIS can say that the initial H1 transfer was approved by mistake without recent pay stubs.

Topic: Received Denial Notice for AoS application for my wife

Has your wife re-entered US after the illegal stay?

Some attorneys (including mine) say that once the person re-enter after violation then it is a fresh start. Find a good lawyer (ofcourse not again with that stupid lawyer) and file MTR ASAP. Sue/Ask him to pay for his fault.

Mine was approved in Aug. 2008 but not my wife's. Yesterday I gave POJ instructions to my wife to find out her case status and surprisingly we got the approval notice email this afternoon without calling. I will take a break from this site. Thanks guys.

My ex-roomate and his wife got hold of an IO through POJ method. IO gave them a fax number to send required documents which was sent by his attorney with a cover letter.

Check with your attorney's office. Their office may receive a courtesy copy of approval and even sometime USCIS sends GC to their address.

My ex-roommate filed his GC with both EB3 & EB2 I-140s instead of actual porting. He and his wife contacted an IO using POJ method and came to know that their case was in EB3 category. IO gave a fax number to send some docs and luckily their EB2 PD became current by that time and got approved in 2 weeks.

Get hold of an IO to correct this. Good luck.

Topic: Why GC should prohibit buying home?

Unemployment benefits and no need to worry about the status is big plus with GC but affordability is very important.

If you do not have GC don't buy home that costs monthly PITI (Principal+Interest+Tax+Insurance) payment 2-3 times of your current rent though the mortgage loan affordable calculators says you can.

One of my friends could not renew his H1B and had to leave the country with a loss of 100K in equity. My desi neighbor lost but found job in another state and getting offers 100K less than what he paid 2 years ago. He is planning to rent it out instead of taking heavy loss.
