Topic: Entered on AP - How long can one stay
you dont need to renew your AP unless you want to travel, an expired I-94 doesnt mean anything you just have to hand it in at the airport if and when you travel abroad you definitely dont need to travel every year to keep ur I-94 valid. Most people keep their H1B's so that the have something to fall back on in case their I-485 runs into any problems, although the debate is still on wether your H1B is valid or not after you enter on advance parole. (just an advice talk to your lawyer to confirm this) |
Topic: Travel on AP and abandonment of 485
you have to return on the same advance parole you left on, which means you cannot use your new parole. |
Topic: interview officer took my I-94

I think this was a mistake, you should contact the lawyer they can have ur case re-opened again, i dont think you would need to apply again. Hope everything goes well for you. |
Topic: Called TSC
the processing time he might be referring to is the FBI press release i.e. applications more than a year in name check will be processed by november 08. |
Topic: Name Check requirement is coming back?
since the FBI has given their deadlines for the clearance of name checks the 180 rule has become redundant or this is what i was lead to believe when i called the USCIS. I think there is a post in here somewhere, since mine has been pending more than a year i was told to wait till november since that is the deadline they quoted for people who have been pending for more than year. I think it is july for people pending more than 2 years and it was april for people pending for 4 years or more.
this is what i was referring to
May 2008 Process all name checks pending more than three years
July 2008 Process all name checks pending more than two years
November 2008 Process all name checks pending more than one year
February 2009 Process all name checks pending more than 180 days
June 2009 Process 98 percent of all name checks within 30 days and process the remaining two percent within 90 days |
