1. Base salary equal or more than current one.

Topic: Birth Certificate RFE - DOB does not match passport and other documents

Ok. Don't try wasting your time in getting corrected BC. It cannot happen in 30 days. I don't want to scare you but any mistake in the response to this RFE could result in NOID. So please work with your company attorney (if you have one) or hire a better one near your place in preparing for this response. You seem to have all the documents that seems reasonable as additional evidence, you just need a very good lawyer to prepare the response. So find one or ask others here for good lawyer near your place. Don't be stingy at this point in time.

Topic: Expected EB3-India approvals in remaining period of fiscal 2008 for Trackitters

Hello am36,
I've an indian colleague of mine who has PD of July 2003 around the same time as me. As per him, he is already pre-adjudicated and is on visa hold. Can you guesstimate when he could be approved? Thanks in advance.

Topic: RFE responded/case proc. resumed vs. Current VB


Guys,
I have responded to my RFE and my current status is "case processing resumed" since may/6. In light of the VB#119, and the rumors that EB3 ROW visas are completely depleted for the quarter, when do you think my case might be adjudicated?
Do you think a visa number has been allocated to me already, since they've issued an RFE?

for your tracking convenience, i read this from other post about the process after submitting RFE.

1st LUD they will pickup your docs and open the cover and enters in the system.
2nd they will scan your docs and will add it into your case folder.
3rd they will review and will decide the case.
4th they will mail docs or attach the 485 case.

In my case 1 and 2 happened in two consecutive days. 3 & 4 happened 45-48 days after the second. They seem to be on track to do it within 60 days whether your PD is current or not.

If the news is true that they don't have any more visa for EB3, then it means, there is no visa available for the remaining months in this 'quarter'. Remember, in this quarter we have Apr-May-Jun, so the visa might be unavailable for the month June. Remember the EB2 cases in Jan-Feb-Mar quarter. It was 'Unavailable' for Feb and Mar, then for the next quarter there was a cut off date...So hang on.....There might be a surprise in the last quarter of this fiscal year!

Thank You very much for the explanation. Now I got it. The visa quota is also split among the quarters so that we don't run out by the first quarter itself. Interesting so even if June VB says U it might move again in July. I'm little bit more comfortable.

i asked if it's just china or india (since i thought she might mistaken me as china), she put me on hold then told me 1 min later that it's for all EB3s.



Then it is a very bad news indeed for everyone (all EB3) of us.

she just told me to check the VB. I asked what that means, she said (not very confidently) that there's no visa till Oct. But i don't know if i should trust her.

I called again and got a different IO and she told me the same-no visa for EB3s. Capped today!



She meant to check the June VB. We will wait to see if they are right. If you had really heard it from 2 different IOs then it coud be true as we are very close the next visa bulletin

If they said it is capped then yes. We will have visas' available only in the next fiscal year 2009.

You are too much narrowly focussed on your todays problem of delay in immigration compared to person from other country. Plz do realize that i am talking for everyone including you without regard to race/country/religion. I'm NOT against merit or open competition and this is NOT about it. This is about how you build a nation with diversity for the future. Unless you are in an open state of mind you'll never get this bigger picture.
