Thanks for your prompt response. I am worried because I am expecting the priority date to become current soon and I am assuming that they will have to pay me the new rate and give me the new position or else I can not get my GC....correct?

Can the employer include Bonafide fringe benefits (401K contribution, Insurance etc) in the total for prevailing wages. I am $15K short on my current salary compared to the salary on prevailing wages and trying to find out how I can match this when the date becomes current. It will be hard to ask for $15K but they pay me $25K in bonafide fringe benefits if I can include that.

Ok Gentle-Nerds, here is my case.

I applied for EB3 in July 2008 which went in to audit and was approved on Oct 2011...long time. Meanwhile I got tired of the wait and applied for EB2 in a different position with same employer in Jan 2011, I got my I-140 approved on May 2011. Now with EB2 India PD coming close to July 2008 I am debating if I should pursue my employer to file I-140 for EB3. Is there any risk for this new I-140(EB3) as the I-140(EB2) is already approved? If I get the I-140(EB3) approved, can I move my priority date to EB2 even though the I-140 (EB2) is already approved.

Any insight on the above issue will be helpful, I am looking forward to hear from the experts who have always helped me.

I am in a similar situation, I have my extension till jan2012 and denied labor is in appeal, any idea on when i can get any response on appeal and can I stills stay till jan 2012 in case the appeal does not goes thru.

How can you do advertisement without the PWD. My lawyers told me that they need to get PWD before putting the add on job board. So i need to wait for 2 month (1 month for advertisement and 1 month for cool off period) after getting PWD. Please let me know how you were able to do it in few days after PWD. I might need to get back to my lawyer if they are leading me in wrong direction.

I am working for an American company which has a branch in Canada, does it counts towards the residency requirement for 730 days to maintain my PR. If not what is my best way to still work in US with the same employer and maintain my 730 days clause. What documents do i need to present to prove my 730 days clause. Can i get a transfer on paper to the Canadian branch and then work in US and a loaner employee.

Thanks Sangiano, that was a well rounded response. Very helpful, I am going to get back with my attorney as she is not giving me a clear answer. I have one more concern in mind, may be you already know the answer to it.

If i have a 3 yrs bachelors from India and MBA from US. Now i apply in EB 2 category do they look at my bachelors or they only look at my masters from US. I dont wont to get rejected bcoz of my 3 yrs bachelors from India. But i also want to have a green card soon. What is the best thing to do, go back to EB3 or EB2. I read this some where that

"06/01/2007: NSC’s General Guidelines for EB-2 Educational Requirements
(1) U.S. master’s degree – as long as it is in the field required no additional documents would be required"

Do i still need to submit my bachelors degree and transcript or just masters as the job requirements states "Masters in Business or Technical field"

It is possible it the next job profile is 50 % different. I am not sure if my employer will do it but i was trying to cover my grounds. Its a story south from this point onwards. A. Extension possible based on the new labor as it is more then 365 days on it

B. Extension possible based on the original labor even though it is denied but it is more then 365 days on its

C. No extension possible as the 365 days rule is only applicable if you are in 6 yrs of h1. New labor is of no use for extension as if was filed in the beginning of 7th year.

any help is helpful.
