Hi
I am currently in H1 status with my wife in H4. I do not have a valid visa stamped on my passport though.
I also have a valid EAD/AP for me and my wife although i have not used it yet.

i am planning on making an international trip , Since i dont have a valid visa stamped on my passport
I intend to use the AP to enter.

I was told that using the AP for entering automatically makes my H1 and my wife's H4 istatus nvalid?
I was told that if you use the AP for entering you can file an INS form to reinstate H1 status.

Does anybody know how to do this?
I want to retain my H1 until i get my GC and i want to know if renewing H1 after coming back on AP will cause any problems

Please let me know..

Topic: Wife's EAD not approved after 112 days ? Do I have to apply for interim EAD (she has valid H4) ?

I went for InfoPass last week, the immigration officer told me that the 765 officer was under the impression that my wife's
EAD was already mailed out, when i told them that was not the case and they could look her case up online to confirm that , they realized their
mistake and promptly mailed the EAD. We got her EAD today..

Hi All,
My EAD was approved in 77 days after i applied, but my wife's EAD
has not been approved even after 112 days!.. We have both got our AP's approved .
She is currently in valid H4 status so we are Ok as far as status goes.

Is it mandatory to apply for interim EAD if EAD is not approved within 90 days OR
should i just wait for her EAD to be approved ?

I have not called the USCIS customer service for status yet.

Please let me know

Topic: !! INFOPASS Appointment on Monday.Should i go ??..Help!

I went to the INFOPASS appointment.
They told me that my application was under back-ground check processing for over a year!!..

They were very courteous and apologized that i did not get this information from the NCSC over the phone.
They added that i should take an appointment and come over to their office anytime i could not get
any question satisfactorily answered over the phone, even if i do not have a Service ID number.

I have read that USCIS is ***planning*** on clearing all applications pending checks for over a year by Nov 2008 and
going forward anybody whose application is pending background check for > 6 months will be given a gc (which
may be revoked if the background check comes up negative).

I am looking to hearing from other people on their experience with this process.

All in all it was not a waste of time at all !..

I saw an InfoPass slot open on Monday, so i took it.
I am going to see what other responses i will get on this post.
If somebody has strong reasons to believe this is a bad idea then i will cancel the appointment.

So far it is 1 Yay, 1 Nay.

Hi,
I applied for my 485 on June 06 2007 under EB3 Worldwide.
My priority date (May 16 2003) became current this year from March - June 2008

My lawyer called USCIS on APR 13 08 and asked for an update on my case,
they were told to wait 30-45 days for update since the case was under normal processing time.

We called USCIS again on June 27 th 08 and were again told to wait 30-45 days for an update. The catch here is that visa numbers are unavailable for the year starting
in July.

My lawyer is advising me to go to the local USCIS office via INFOPASS and ask about my case.

Should i go or wait 30-45 days? The visa numbers will not open until Oct in any case.

WILL GOING TO THE USCIS OFFICE BE POTENTIALLY DETRIMENTAL TO MY CASE???

Any help will be appreciated !??
