Hi all,

I tried to read through the news articles and USCIS details and have been hearing conflicting things from different people. Wanted to make sure what is right.

I have an approved I-140 (EB-2) from my previous employer which has not been revoked yet and mostly will not be revoked also. PD is Jan 2013. Some people are saying that people can now apply for EAD if I-140 is approved and the date running is in 2014 but the dates seemed to have moved only till 2011 for EB-2.

I don't know if I can use my I-140 and apply for EAD since I left my last job. It might not be possible. What is the 2014 date and where are people seeing it? I don't anywhere I saw.

Topic: Visa dates availability April/May question

Hi all,

If this is not an appropriate question for this thread then I apologize but I don't think it is.

I am booking my visa dates for the end of the month but because of some clarifications, I am unable to finalize my DS-160 and submit my application to look at dates. Can someone tell me if there are good number of slots available in Hyderabad consulate towards the end of the month or early May or is there almost no availability at this point? Sometime between April 27 to May 5 is what I am looking for.

Topic: Visa stamping question

I have to go to stamping in India towards the end of this month and I am booking visa dates. My question is, my employer has remained the same but the company name has changed from "XYZ Wireless Data Systems Inc" to "XYZ Wireless Network Corp". My employer has filed an amendment to my H1B and I have a new H1B with the changed company name. It is still the same company. Is it necessary for me to attend the visa interview or can I use the dropbox?

I consulted with the company lawyer and she is not sure of this and asked me to check with the US Consulate of Hyderabad. Also, does anyone have the best contact phone numbers, emails etc for the Consulate to ask them directly?

I-140 can be amended. How can you be so sure that you can't amend it?
Our company had a name change so we had to file an amendment for my H1B (which came through) and now for I-140. I have provided as much details in as much clarity as anyone could.

Hi all,

I was just told by my lawyer that my I-140 amendment which was filed in premium was switched to regular processing (the premium part was returned) probably because its that time of the year April 1st week. We are also filing a H1B amendment for my wife this week which is really needed for us to travel to India at the end of the month and premium processing here is a MUST if we have to travel at the end of the month. Does anyone know if USCIS sends back premium applications at this time of the year because of the April 1 date? Or was it just my I-140 that was sent back as it's not a priority?

All,

We were acquired by a parent company almost 2 years ago but we had the same federal tax id as our previous company. Now all that has changed and we're now the parent company itself. The tax id and everything have changed. HR has done this without consulting with the immigration lawyer. Has anyone been through this situation before? What happens to my approved I-140? I hope I don't have to file PERM, 140 again :(

Topic: Obama - EAD Pre register question

Hi guys,

After yesterday's announcement people are saying that if I have PERM/I140 approved and even if I change jobs right now, the I-140 cannot be revoked and I can pre register for EAD. Does anyone know if it's true? Say if I change jobs next month, will I still be eligible to pre register for EAD if my employer doesn't revoke my I-140?

Topic: H1 to H4 to H1 - cap exempt?

Hi guys,

So I am planning to switch to H4 for a couple of months and then find a job and get back to H1. I have been in the US for 6+ years now, my 140 is approved. I have 2 questions:

1> If I get back to H1, after doing a COS to H4 and back to H1, do I need to get into the quota? I really hope not.
2> If my new company files my GC, will I keep my PD (if my old company doesn't cancel my 140 that is)

Hey guys, one of my coworkers told me this and i'm not sure how much this is true but here is the scenario

My H1B expires in Jan 2015. My PERM has been pending for more than 15 months now, it's audited and I don't know how long it's going to take. The company is very irresponsible and this is probably the first GC they filed. They already screwed up my LCA applications and other applications before and work stress is also insane. There's a good chance they screwed up my PERM also which is probably why I got an audit. I can't apply for H1 extension before 6 months of my visa expiry meaning till June this year. I was told by someone that if my PERM has been in process for more than 1 year and if I apply another H1 now with a different company, I will get my extension till 1 year after my current expiry?

So in short, if I change job and file another H1, will I get H1 till Jan 2016?

Exactly what happened with me. I filed my PERM with company X and after a couple of months we were bought over, they retained me, laid off a bunch of people and I got an audit on my PERM and I have been waiting for more than 15 months now to hear back from the PERM. I think you should be ok, except that I would say the chance of an audit is high because of the acquisition. Mine got audited because of the that.

I don't think thats the case because if that was the case wouldn't we see a lot of denials in the tracker?

Also, I have been following the CTS thread and no one seems to be talking about denials there.
