Additionally, I have 3 questions -

e. Based on my I140, I got 3 yrs extension (currently on 7th yr of H1b). Do you see any issues in renewing my next extension, if my employer still don't file my GC by then? Don't you think USCIS will question the employer, why he has not file my GC, priority date being current?

f. What option do I have?

e. Do you think Switch job anytime within next 3 yrs, will get me 3 more yrs, provided my I140 is not revoked by current employer?

Gurus,

I need your advise. Here is my situation -
Status - I-140 approved/EB2/Priority Date Current (fall under ROW)
Problem - My employer is refusing to file 485 based on my current salary which is not lower than prevailing wage by $9000.
Questions -
a. Is it mandatory for employer to give me salary as per prevailing wage, once I get my green card?
b. How does USCIS comes to know whether employer is giving this prevailing wage or more to the employee?
c. Can I file I-485 by myself (with help of attorney) instead with my employer? If yes, what employer related documents are needed to meet this?
d. For filing I-485, do I need to meet prevailing wage?

Sorry for lots of questions, but I hope you understand that I am so close but still so far from getting green card.

Hi, I am new to this forum. I am very happy for all H4 holders. I believe this couldn't be a better Christmas gift.

I have couple of questions -
I will be on vacation (to India) on Dec, Jan and Mid of Feb.
a. Who can file for my H4 EAD ? (Me or my spouse's employer)?
b. Do I need to be in US to file?
c. Is there any quota (such as - 1st come 1st serve)? or I can still file it once I am back from my vacation, since it is not quota or lottery?
