posting again since i didn't get a response yesterday....

1) I have an approved I140 from Company A, but i am working with Company B now where i have just started the GC process again. Will my spouse be eligible for EAD under this proposed rule?
2) What is the average wait time for EAD once you apply? Is there anyway to apply under premium for EAD as well if this rule becomes current?

hey guys,

Been a silent reader, i have a question for the experts here! What are the timelines for this rule? As per my understanding the comment period was open on May 12th for 60 days.

From my research so far, this deal is pretty much a done deal! Stop worrying about negative comments they mean nothing...but if you do comment, please check your spellings/grammar. The govt should not feel like "are we going to let THESE(people who can't frame a proper sentence) people work?!!!"

Anyway back to my question. Here is my situation(cliff notes)

- Got my I140 approved from Employer A.
- Moved to company B. Just began my GC process in Company B.
- Got married in Sept 2013.
- Wife moved here on H4, applied for H1 this year.
- Wife's H1 petition was picked up in Lottery. Her petition should soon be approved and her H1 effective Oct 1st 2014 .
- Wife's H1 applied as COS from H4--> H1

My question now is, how long does the pundits on this forum expect this rule to become active? Let's say this rule becomes effective Oct 1st, how long does it take to get the EAD approved once you apply(3 months?) Is there a premium processing for EAD?

I wonder if we should plan to switch her back to H4 to take advantage of this rule?
