Your wife can certainly go for her stamping without your h1b being stamped. Make sure that she carries with herself;
Your ORIGINAL I 797, I 129, LABOUR, EDUCATION EVALUATION , PHOTOCOPY OF ALL YOUR ACADEMICS AND EXPERIENCE CERTIFICATES , a copy of your passport with expired stamped visa, MARRIAGE CERTIFICATE and last but not the least a LETTER FROM YOUR EMPLOYER & PAY STUBS.

I recently came back from india in almost the same situation as your wife would be. The VO was only interested in my husband's I 797 and copy of his passport with the EXPIRED VISA STAMPED ON IT(whatever it is H1 or F1).

hi Sridhar,

Are you 100% sure that the letter bears individual's particular name on it because jus now my friend called and said that the consultant showed her the packages for some other and none of them beared anybody's name.so its a common letter for all.
The letter only says ............that the enclosed application got rejected because was not selected in lottery bla blah............
i mean it doesnt have the persons name anywhere(which the consultant says that they cannot type so many letters for so many candidates)
I am sure after some days he will show her some forged letter and fedex receipt but none mentioning her name.
I am personally getting involved because she lost her whole one year and i want to teach her eployer a lesson.

Hi SV,

1. I stay in CA, which consulate would be better to go to? Canada or Mexico?

You can go to any of the consulates saying you had a vaccation plan for this place so came for stamping.......i myself once saw a girl advocating hard with VO in torronto that she cannot go to india for stamping because had enrolled herself in some stupid silly course and cant miss her classes for many days(of course you should a proof of that).

2. Will there be any issues if I go to any of these consulates as its my 1st H1B stamping? I want to get it stamped before I travel......................................

You have to go to chennai consulate unless your company's lawyer files a petition to change the consulate to mumbai due to some travel plans.

3. and 4

You already got one I94 with the approval notice. As long as you have aproval notice(I797 ) from USCIS you dont even need to get your visa stamped. You can always start working after 1st oct and once you have 2 or 3 paystubs can go for a safer stamping with that.

But for your question as long as you have a valid I94 and approval notice for h1 i think you can make an entry to US(im not very sure on this).

Hi Sridhar,

My friend's employer emailed her a scanned copy of the letter from the lawyer saying that due to unknown reasons they haven't received the documents back from USCIS so they have emailed scanned copies of the cheks made payable to uscis,
an invoice from the lawyer.
Can you please confirm from your friend :

1)if that letter from USCIS mentioned his name saying 'MR. X didn't make it to lottery' or just in general saying " The enclosed application didnt make it to the lottery".
2) Did he get the fedex receipt for sending his application to USCIS with his name mentioned anywhere.
3)Which document is the most authentic proof of his application being sent to USCIS(I mean the stamp from USCIS as recieved).

I am asking all this because i think that her consultant can easily forge someone else's documents and scan and email to her, if she pressurises him too much.
We are planning to go to district attorney's office and it will be really helpful if we have an idea about the above mentioned points.

Hi Canica,

Have you applied for H1 as a teacher? If so then it is for sure lottery exempt. I know a lot of people who are on H1 in education stream and none of them ever went through lottery system. Let me know whats your major and which part of education industry you associated with.

Hi All,

I need your help on this. One of my friends applied for H1b through some consultant and charged her $2000.
Since she didn't get selected in the lottery she asked for the $1500 refund also through some internal resources she got to know that consultants have befooled her and actually never applied for her H1. Now she wants to know if in this situation what would be the best thing to do. She is not willing to take the $1500 but wants to teach them a lesson.


Will highly appreciate your advise on this.
