Topic: What types of Traffic Offense will cause trouble for GC and Naturalizaiton?
Hi everyone, I keep hearing people say some traffic offenses will cause trouble for GC application and naturalization. My understanding is these offenses include:
1) DUI
2) Hit and run
3) Reckless driving???
My concern is: in the past I had once merged into a highway earlier than should, and got a ticket with the citation something like "Improper turn..", with 4 points on it. I went to the court and got a bargain, they changed the charge to a different category with a higher fine but no points. The problem is I remember they changed the charge to something like "Reckless driving". But is it supposed to be a lesser charge with bargain? Since it was so long ago, I don't remember the exact wording of the charge. Should I be concerned?
Also, do FBI check the person's driving record for 485 adjudication purpose? I never been arrested, not sure if these tickets are in the FBI database or something similar.... |

Topic: Going for Infopass?
Recently I'm starting to think about going for an info pass. My case is EB2, PD current. The problem is that I just submitted 485 this past July, so 485 pending not reach 180 days yet. Is it too early for me to go for an infopass?
Also, if I decide to go, how do I set up an info pass appointment? Will infopass has any impact on the case processing?

I don't think I-140 has an expiration date.
Labor certificate has a 180 days valid time. If 140 not filed within 180 days of approval, LC becomes invalid. |

eadseeker1974, I saw you have a 485 case listed, did your 485 really get accepted and have a 485 receipt notice assigning case number etc. If so, you can apply for EAD. If not, you probably in a lot of trouble, since you didn't maintain your status since 2006, even if your PD become current, you cannot apply for 485 though since you are out of status more than 180 days.
Your lawyer did not advise you to get a h1b visa, or went back to school to maintain full-time status after your OPT is over, that is really bad. PERM and labor process by itself is not a valid non-immigrant status. Even though your I94 says D/S, if you did not get a H1b status, or went back to school registering active in SEVIS system, you are still out of status. Sounds like your lawyer was talking about possible 245(i) extension, which is highly uncertain. Especailly considering such a bad economic environment, don't rely on such possible bill pass, which may take up to whoever knows how many years. |

How long does the CIS give you to respond to RFE?
Maybe you can book an appointment and apply for a H1 visa stamp within 2 weeks. Applying for h1b visa stamp is relatively easy, compared to other visa categories. In the worse case scenario, if CIS reject/deny your I485, you can refile another one with approved I140, and the 2nd 485 will be protected by 245(k). |

The domestic violence case probably works if the abusing spouse is US citizen, not sure the abusing spouse himself is the primary 485 applicant.
Isn't a dilemma about this? To keep old 485 alive, need to prove domestic violence case. But if the primary applicant is convicted domestic violence, highly likely his 485 will not be approved. If the primary 485 is not approved, how could dependent 485 be approved? Maybe the best way is to get your own LC, 140, 485... |

You probably can get your lawyer send them a letter, or try to talk to an immigration officer there.
Just curious, you submitted your application in 2007, how come your namecheck didn't start until a year later? |
