so if name check is cleared which is the longest one of all, what kind of security check are you stuck in. Rest are fairly quick.

yes you are right. You can continue to extend this H1 many times. The key thing to remember is this. If you 485 gets denied, You h1 become invalid, regardles of time left on h1. Please consult some other attorneys and they will tell you the same.

so I Understood it correctlly, one can use AP and come back and be on h1. However that would mean that H1 will now then play the role of EAD. So if for some reason the 485 is denied, your H1b will become invalid just like EAD would have been. So to answer the quyestion, IMHO, I dont this it will be safe to travel on AP and then come back to use H1. If you have valid H1, try to get visa. If not then remember that H1 will be playing the role of EAD when you come back using AP.

I guess they are correct when they say AP is only for emergencies and not vactaion.

I alway apply but never use it simply because of all risks.

Topic: EAD Card Prodution ordered

Hello,

First time when I applied for EAD, once it was approved i saw the message like, This case has been approve. This year I applied again on Sep 17, 2008. This is the receipt date. Today I see a messsage on mine and wifes EAD that Card production ordered. However, no email was recived or the status of the case changed to approved.

What does this mean. I see no LUD on my 485 application either. My AP application has not been touched.

Topic: What's the difference of background checks between EAD, 131, and 485?

So I applied for my EAD and AP last month. Its only been a month now so I dont expect approval anytime soon. Althouh a couple of co workers got theres approved in a month. Anyhows, I never gave finger prints for these 2 applications. I dont remember my co workers going for finger print as part of the process to apply for EAD and AP. there were renewal. Should we have gone for finger prints or are they asked on individual basis.

I do have DWI. (criminal record)

Hey ashton

Cangradulations. I feel very happy for you. My query to you is in regards to your husbands DWI. Can you tell me a little bit aobu this. I too have a DWI form 2000. My case is EB3 in Texas. As of now, I have not heard anything from them in regards to interview, but I suspect i will be gettin one soon. I too will have 2 kids. Well 1 on way any week now. so a total of 2. Can you tell me if his DWI caused any problems with this case. When did he get his DWI and what kind of sentence did he get. What kind of documents did you all take to the interveiw. Legally, i have heard that 1 DWI should not be enough to deny green card, but that is to the discretion of the officer. anyhows, I am sure your input in this regareds will be really helpful to all of us here as many have DWI and other offenses.

Topic: DWI and affect on Green card

Ok, You say you a guy who moved. Well please get with him and ask for his permission so that I could peak to him. I got my DWI in 2000. Guess what, applied in Candas last year and got rejected. My rehap permit was not approved. I ad over 50 letters from community leaders, CEO of my company, manger of my department and many more. Even my probation officer wrote a letter on my behalf and yes it was as positive it can get. So I would love to talk to your friend. If he had done it then I think his input will be very beneficial to some people here.

As far as denial goes, well The interviewing officer has god rights so he can reject application even if there is not reason to reject it. They use discretion. As far as law is concerned, even supreme court has ruled that DWI even with injury is not CIMT or crime of violence. My attorney told me that he has had people get green cards with 2 DWI's. so it depends on how the interviewer looks at that situation.

Murthy, rajiv khannas all had stated that by law it can not be rejected, but depends on the officer, and thats why you have appeal. My h1 extension was rejected by some officer. I file a MTR, and the service center director approved it stating that denial was a mistake. Yes they do background IBIS check on all immigration applications. with Green card, name check is one that gets added.

So please ask your friend if he can shed some light as to how he manged to move to Canada with DWI.
