His H1 is already approved with Company-B and He will be Joining Company-B. I am guessing it would be just a change of status. But COS is taking around 5 months. I do not know whether premium processing available for COS.

1) Is it possible to move from L1A to H1B being in USA ? yes
2) If there is a way, how much does that cost (I heard that, it will cost similar to new H1B) ? I guess it is just a Change of status. It is I-539 should cost between $500 to $750. Some one has to confirm.

To avoid all these hassles for you and company-A. You could directly get your H1B stamped and enter USA.

If you are unable to get H1B stamp, then go for L1A and after arrival, apply for change of status.

One of friends was in the similar situation, He took 2 appoiintments one for H1 and one for H4 two days later.

When his wifes H1 was denied. She attended H4 interview and got it stamped and reentered US. again applied for COS back to H1.

My wife appeared for H4 stamping at Hyd consulate on Aug1st, CO said the visa is approved, 4 working days past and the passport is still with post.

CO : what does your husband do?
Wife: Project Engineer.
CO : what does he do?
Wife: engineer and after a while project manager (I was project manger previously in India)
CO: how long have you been married?
Wife: 19 years
CO: Dont you know what your husband works on even after 19 years?
CO: your children are in Middle school is it. I am doing a favor for you, I am approving your visa but it would be difficult at port of entry.

My wife could not complete her 12th because of marriage. I hope the passport will beready for pickup tomorrow.

Please share your thoughts.

I took an appointment for my wife at HYD consulate, on July 26th.

Finger print appointment Jul 31st, 2:00PM
visa appointment Aug 1st 8:00 AM.

the appointments are available with in a week. Good luck

You have to apply for H1 with another company in apr 2013, which will be effective from Oct,2013. your wife can be on H4 and own the business, she can not directly involve with day to day operations, but she has to hire people to run day to day tasks.

That way way you can apply the greencard with the new employer and keep extending your H1 until you get your greencard.

I believe OP's employer can file H1B in 2014 quota in Apr 2013, requesting a start date Oct 2013. This has nothing to do with OP's stay outside USA.

OP should be outside USA for 365 days before entering on Fresh H1B for 6 years. He should consult attorney when he can apply for visa stamping.

I guess your friends in USA can close bank safe box. sell car and sell house stuff.

If it is in detroit, I can help you with that.

That way you could avoid the legthy and risky process of getting B2 visa.

It is 366 days, so your H1B clock reset until 11/10/2016.

Even though you have not worked/stamped, your H1B can be transferred over.
