Topic: Question about job at the airport when returing the US

I visited recently my homeland and at the POE I was asked where do I work, what do I do and how long I was away and for what purpose. The definitely ask you for what work are you performing and where. That is my experience.

Topic: USCIS field officer came to my job place today...........

I would ask your lawyer about your situationregarding your prevailing wages and if there is any risk with the terms of your H-1B, mostly when it is time for renewals, extensions, etc. What USCIS is trying to find out if if you are in compliance with the H-1B and that includes that the sponsor demonstrate ability to pay your salary specified in your prevailing wages or at the time of resuming your case. It is tricky because it is an estimation within a range, so it is always better to be paid at least the prevailing wages but not less to avoid USCIS rising doubts about your sponsor financials.

Topic: *** Call to Action ***

I am a EB3ROW green card holder. My experience with Gutierrez office at Chicago was honestly discouraging and deceptive. In 2007-2008 I requested constituent help from his office from their office in the north side to resolve some USCIS errors and matters that had my case stuck beyhond normal time, and I found them to my dismal pretty much saying to me that because my case was 'straight forward and clean and I was legal" I should seek help using other channels because they 'prefer to focus their efforts on illegal and latino cases'. I was shunned to find out that in order to get help, illegals latinos had priority over me to their eyes. I went to Obama's constituent services (before winning presidentials-now closed) and there they were like a second family to me. Specially Mr Sam Rosengren and his team were so supportive and on top, helping out to the very last minute with my case and they did an awesome work I will be thankful for the rest of my days. Also Danny K. Davis (D-Rep) Constituent services were of so much help with my request. I have concluded that in order to get help, whom supposedly should be helping me considering that even they are culturally closer to my nationality, ended up kicking me out big time and left me stranded; but the ones that were less likely to become really helpful were completely overwhelming helpers as Obama's office and Mr Davis office, both African American. I find this to be a paradox and my vivid experience was that Gutierrez office is segregated and focused on lobbying for the illegal immigration, and for them we legals dont mean a thing, he doesnt care at all. Anyways, I got my GC without his help, and I learned the lesson. Now I dont care at all about him or what he supports because obviously he is a selfish individual with an agenda far from ours. I would not have any expectation from his efforts unless I was Illegal and latino.

Topic: Typo error for DOB in I765 application and how to get it correct?

IMHO I think that those issues can be resolved by submitting ammendments. Ammendments are requests for corrections, wether if they are by your error or the CIS, to have them adressed. Is up to CIS to admit the ammendments and issue a SR to document the process and track it down. Normally they are resolved without problems if documented and well presented by your lawyer.
I dont think you will need to file again and pay new fees to correct a typo. That is what ammendments are for. Ask your lawyer and dont delay it. Good luck.

Your lawyer should send a letter to the appropiate uscis center and request the correction/ammendment by providing/documenting the mistake and open a service request that you can track down and inquiry about in time.
The last resort is having your congressman and ombudsman involved. In my case it worked and dates were corrected after Ombudsman office did the inquiry following my senator's attempt, which succeeded.

Topic: Immunization for Medicals - what all is needed?

If you have insurance benefits, do manage to do your immunizations with your family or primary physician at your hospital and you may save a lot of money. I did that and took only the strictly necessary tests at the USCIS authorized physician to complete the medicals. They will attach both and seal the results to submit with your petition. They normally give you a duplicate copy of the results for your records.

Topic: Does contact of congressmen/senator with complaint filing to Ombudsman do adverse action on my 485?

My experience with my congressman constituent was always positive and instead of having a negative impact, was very positive and even helped in some areas wher lawyere could not.

Topic: Country based GC - Sucks bigtime !!!

"...independent than how many ppl applied per country"

that is the problem. It can not be independently of how many people apply per country bc overpopulated countries with a flood of applicants for themselves and usually a big crowd of dependants can consume all the visa numbers leaving almost nothing for the others. It is not reallistic, nor fair. It will never happen.

Topic: Country based GC - Sucks bigtime !!!

A lot has been said about this matter before, so it will always bring controversy. The facts is that the per-country allocation is not perfect, but try to guarantee diversity by avoiding some overpopulated countries monopolizing by flooding the use of the whole limited number of visas available leaving fewer chances to other countries. Simple mathematics. It is just what it is and does not have any shade of racism, segregation or separation, just the opposite. It is a difficult balance and there always be somebody taking sides because feels it is unfair. We always forget the USA is entitled to offer these privileges the way they want, and we are free to take the choice as is or leave it. Aint no point on getting mad at it because it is our choice to go through the process. It is voluntary.

Topic: Exorbatant Lawyer Fees

In between $2500 and $3500 for 1 person, including many service requests, AILA liason contacts, and other documentations, keeping up with everything on time and having an excellent profesional relationship along 5.8 years il took me to get my green card navigating through backlogs, fiascos, etc. Those fees were well deserved and earned, mostly at the time of preparing the i-140 and being on time using all resources available in my behalf. If it is in the Chicago Area, no doubt I would recommend him like gold: Law firm of Scott Pollock & Asc.

Topic: When do you give up?

You know, I have been into this process since Aug 2002. Rained a lot since then and It was really stressful and annoying at times. At the end its just a mater of endurance and testing your ability to achieve things enduring. Dont give up. the enormous feeling of pride and achievement after sorting many struggles will make u stronger, and u can walk out there free of load knowing what u went through until that point. If u put so much on this, never give up. You will made it against all odds, and believe me, I used to have everything against my chances for many years and I made it just few weeks ago.

If im correct my lawyer emailed by 11/19 and we had the CPO by 11/21 past midnight just on time for thanksgivings. I believe the streamline request was implemented the day before we used it.
