Topic: I140 Nebraska processing time in Regular Process

anyone from March 2017 - EB2 India, Regular processing still waiting?

The processing times on USCIS website is probably false (it says June 1, 2017) since I see folks from Feb and March 2017 haven't received approvals.

Anyone else agree?

Topic: H1b extension processing time - Vermont

Hello all,
I need to renew my passport and my H1 extension is still pending. I have my receipt notice of September 04, 2015 but not sure when I will get approval. BLS website says the following:

"If your visa has expired and/or or you have the receipt notice for extension of your visa then: NYC, SFO & HOU Jurisdiction Applicants - must provide a notarized no status affidavit with photocopy of the valid passport and the green card of two witnesses duly notarized + 7 Copies of Nationality Verification Form (Given in Point 2 above) are required and each copy must have an original photograph affixed on it."

Has anybody followed the above process? I don't know any green card holders but I know citizens. Can someone please help me if they have done their passport renewal successfully? I am stuck :(

so what do you suggest should have been done? "keep quite because it will affect my GC application" right?

and you are saying that spillover dried up because of attention to visa bulletin and IV?

so you mean if all of us kept quite the spillover would still be as high as last year and we all would be current and then pigs would fly and rainbows and unicorns would be everywhere.

Two problems with your assumptions:

1. "Now with most of the I-485 filings done earlier, most of the spillover is going to be negligible. " This is not true, please read Zzzzz's post on this thread. Spillover is not negligible because of the fact that 485s are being processed earlier.

2. "Now with most of the I-485 filings done earlier, most of the spillover is going to be negligible. " Even if this was true, I am still trying to understand how do you say that this happened because there is more attention on the visa bulletin now and that too because of IV.

Anyway, your argument and assumptions are flawed on so many levels that its not even worth asking you to explain your logic..

Would you please enlighten us as to how you arrived at the conclusion that the spillovers are not being applied to EB2I folks just because there is more attention on the visa bulletin now?

Are you trying to say that USCIS spillover rules factor in how much attention visa bulletin gets?

Quick question. I was under the impression we are only supposed to submit I-797s (proof of status) since our "last" entry to US. Is this not true? Did you submit All the documents ever since you stepped foot in the US? like I-20s, OPT, H1b ??

so which one is it? proof since last entry or proof since the time you first came to US?

I did not know you could regard an in-process i140 application under concurrent filing. Please ignore my advice above.

you can say :

you must have an 'approved' immigrant petition (i-140) in order to adjust status. source = http://www.uscis.gov/sites/default/files/files/... Page 1. under "Who may file form i-485".

Also even though the above says that an visa number should be immediately available, the current visa bulletin says the following:
Applicants for immigrant visas who have a priority date earlier than the cut-off date in the chart may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. source = http://travel.state.gov/content/visas/english/l...

let me know how it goes!! good luck... (i'm amazed at how attorney's are keeping candidates in the dark like this by using false information)

i-140 needs to be approved. you can upgrade to premium for a decision. If approved, you will be eligible to apply for i-485
