Topic: EB3 Awaiting Green Card
My guess is that if it was already with an officer just before they all went to "U", you'll most probably be "pre-adjudicated" because the officer probably finished up what he/she was doing, at least to the approval stage, and then as soon as USCIS open the window up again at the beginning of October, the pre-adjudicated cases will be approved first.
As for ones with later RD's, who knows. |
Topic: What is the order in which applications are processed?
I think they take a big stack of files to the top of the stairs in their building and throw the files down. Whatever lands on the bottom half of the stairs gets processed first, and whatever lands on the top half gets processed last. And any that fall all the way to the basement by going in the middle of the stairs get rejected.
Or something like that. ;) |
Topic: Medical when PD not current? How to make sure there is no RFE because of medicals?
I wouldn't do it - wait until your PD becomes current. It didn't take me much time at all to get an appointment and get it done - I didn't have any TB issues, though, but remember the date for which PDs are current is announced 2 weeks in advance in the bulletins. You will have that time to arrange medicals in advance of being able to file. And even then, if you end up filing a week or two after the earliest possible date for filing, it's probably not a big deal in the grand scheme of things - it's not like USCIS are terribly logical about deciding which application to process next, so it's not a guaranteed FIFO processing. |
Topic: are PERM cases being approved and RIR cases backlogged?
I thought PERM only came in during 2005. ??? I'm probably wrong. But I'd think a lot of 2004 and 2005 cases are RIR or other labor cert. cases because it was a fairly slow switchover as lawyers wanted to wait and see if PERM really was quicker. |
Topic: Is this usual?
I thought they were always supposed to send them to the applicant directly so it doesn't seem usual to me. I wouldn't worry for a while yet, though, yours may come soon. What's more important is that your wife's has arrived, and hey, at least it went to your lawyer and not to a completely wrong address. |
Topic: Posting in your native language
Guys, as someone who doesn't understand Hindi at all (or many of the other languages that are posted here), just from my point of view I have no idea if you are making a joke, congratulating someone or talking about something else. I think it is fairly clear in a post that starts off "I got greened!" and then people post "congrats!" followed by a few words of another language that what is being posted is innocuous congratulations or commiserations or whatever. But the problem is when you're in a conversation about something actually useful or about a point of how to do something, or what should we expect, and it veers off into another language, those of us that don't know what you are saying get completely lost and the whole thread loses it's usefulness. Especially if people start thinking that you're making a private joke at their expense. Then Trackitt doesn't become as nice of an experience for everyone else because they worry about what is being said that they can't understand, and people stop coming here because they think it's only for Indians.
What we have in common here is that we are all immigrants to the US, and we all supposedly speak English, at least to some degree of competence. Therefore I'd love to see all posts in English and about immigration - unless it's in the waiting lounge. Or at least only use your native language when what you are doing is clear to the rest of us, like offering a few words of congratulations. To me, it's not a free speech issue, it's a courtesy issue. |
Topic: Illegal acts with GC
Well, I tried doing some more digging so I couldn't find anything. But maybe I'll waste some more time later in the day if I get bored at work. But essentially, immigration law IS one of the federal laws. So even if what you are doing is breaking a very minor prohibition in the immigration statute, you are breaking a federal law, and then the criminal statute (18 USC) comes into play through this provision.
Unless I can find something specific, no, I wouldn't necessarily regard it as a crime. Kind of like I wouldn't regard jaywalking as a crime, though technically it is. (Maybe - I have no actual knowledge of what jaywalking really involves - whether it's a city ordinance or what.) However, it is probably one of those things that they throw at you when they want to get you for something else, you know, just to pile on the offenses. Or maybe they can't get evidence for anything else and this is what they charge you with - you know, how the mob bosses were actually charged with tax evasion or mail fraud rather than murder. Or maybe they really do scan all mail for green cards and passports, what do I know?
I suspect that there's some law on the books somewhere that says you shouldn't do it, and then all lawyers are duty bound to tell people that you shouldn't do this because it's illegal.

Topic: what happens when u get RFE?
Yes, it's quite normal. You get the RFE in the mail (well, your attorney will if you appointed an attorney) and it'll set a deadline for response. I think you get more time if you have to supply harder-to-find documents. Then file the response and they'll pick it up quite quickly after that. I got my approval within a week of filing my RFE response. Having said that, there are people who are still waiting for approval months after filing their responses, so like with anything to do with USCIS you can't always accurately predict.
At least it means they are looking at your case, though, so that's a good thing! I hope you have an easy RFE and can turn it around with no problems. |
Topic: Do you believe in all approvals posted here ?
I don't see why it's a big issue. There are a lot of people who don't want to discuss and just want to lurk silently. Then they add their cases when they get approval. Of course, they could silently lurk and have added their case when they filed, but maybe they didn't know about Trackitt then, or maybe they thought having their cases in the database as only filed and not approved wouldn't help anyone. I think most of them are probably real cases. |
