Thanks kaisa2007 and thirdattempt!!!. ( ironically enough mine is 3rd attempt as well :))

The article puts very much in unambigious terms....let me see what my attorney has got to say about this. I'm worried that he might take all my 'research' as an attempt on his pride...

I'll atleast hope...he is professional enough to accept his mistake.

SP, as you mentioned that your "PD: was 06/07...but my attorneys @ fragomen insist that I have to WAIT outside for 365 days no matter what now" ..why he is asking for another 365 days ? basically since your PD which means your labor applied date is 06/7 , which means from 06/07 your 365 days will be completed in 06/08 which is June 2008 , means by June you will be entitled for 1 yrs extension and u can come back ....does it make sense ????



I guess uou are mistaken about H1 extension. He is not in the US. H1 status is over once someone leaves the country, so you can't "extend" that H1 now?

The above statement exactly....is the POINT OF DEBATE. I emailed Greg Siskind and he feels I'm eligible...but Fragomen does NOT. Articles in murthy.com are left for user interprations...which I always do in my favor:)

Answers to your questions:

1. I did not resign nor my position terminated. I was trasferred to a different country, with in the same company on the same 'Pay' and same position.
My H1b Visa and the official copy (I-769) expired on the same day. yes, I had a Visa samped until the H1b expired.

I did not understand the second question...completely.
"After your left US did you get a H1 visa stamp on your passport based on your H1 extension (per your profile) "

I left US because my H1b visa & permit expired. Why and how would I be eligible for any further stamping on passport?

Yes. I can work outside of US...for the same company. Please cross-check with your attorney, before you fall into soup as well. I used to think just as you are...but the reality is different. If you know appropriately how many more months your 140 could take....you can stay outside the country for so many days upfront and get back in right after the 140 approval.( avoid H1b expiry )


In any case....you have to start planning now...since August is only couple of months away.

Thaks for your reply. Mine is little more complicated than what your attorney may have answered for...
My H1B expired ( 6years + recapture time ) and I'm not living in United States...any more. This is where the problem creeps in, whether I can extend/reinvoke the expired H1b upon my 140 approval?

Can anyone from non-fragomen attorneys confirm this 1 year wait-out? I think these fragomen suckers are with every big tech company....bent on screwing the EBs

Just as the Title says it all...I had to leave the country last month because my 140 was pending and PERM was filed less than a year ago.

Now that my I-140 is approved...are there any options other than wait-out for 365 days?

Topic: Soft lud on approved H1B notice

I got a LUD on 02/17(sunday) for my approved H1-B(11/07). My I-140 is still pending(09/07) with TSC...not sure if this is just a coincidence or a result of some mass update.

Any ideas?.....
