I did get their attention when I said, ' Is being legal a disqualification'.

I also voiced that although we are in legal status, we still live in fear. Our status is all depended on whim of employer.

We are treated as illegal when we go to embassy in home country.

The only answer I got was 'No personal questions' and send a email to outreach@







I think that was not a personal question, this is an issue faced by 1000s of families. They just had no answer at all to the question so they ducked it by calling it a personal question.

Considering that the H4EAD campaign was heard in the highest levels of decision making, there certainly is a scope for another campaign for H4 children. However I am not sure if there is a solution by executive action to the problem. The issue could go away if dependent counts are excluded or visas are recaptured. However I-140 EAD does NOT solve the H4 kids problem.



I think the numbers are less for this case. Mostly persons who are applying gc with 10 to 15 year old kids are facing the situation. I will estimate a few hundreds and in future it will be decreased as most person coming now are youngsters.Even then most or all children can get F1 when they are in college. I think at the time of filing I485 they can still adjust the status if they filed Perm before ageout. If you take the issue at proper level they could consider but that will delay the H4-EAD process further. Best way is wait for results of Visa modernization and if nothing happens in that you can try add as expansion after H4-EAD is implemented



Few 100's? the entire EB3 India queue faces this problem, last time I checked that was 44,000, not to mention a considerable number of EB2 families as well. The children can get F1 but they pay international fees and with no financial aid. That can be very difficult if there is only 1 earning member in the family. After the F1, the child has to hunt for an H1 status and if she/he not in the stem field then that door closes as well. As for AOS at I485, that could take several decades for an EB3 family. I agree that we should not try to get that included in the current H4 EAD rule. I was proposing a separate campaign.

Problem is that ageing out children cannot be included since that would need additional GC numbers and that can only be done by congress

Exactly the same situation as me. You have not mentioned that the children would soon be ageing out of H4 and will have to look for their own H1 or F1 status and the whole rigmarole starts again
