If anyone who visits USA through B2 visa , stayts in USA for 6 months and comes back to home country , say India how long they should stay in India before making another trip to USA. Can they come back to USA after a month and again stay for 6 months in USA ? Could you please let me know the policy ? Thanks in advance.

Once my wife get approval for Cos from H1 to H4 and if she finds a job can her employer file back a COS from H4 to H1 under cap exempt and what will be the fees?


If in the process on CoS approval from H1 to H4 , she gets a job, can her employer file COS from H4 to H1 ? What is the fee? What are the problems involved?

Thanks for sharing the info. Does that mean she just went to US consulate for h4 stamping?

I ask this because i recently moved to new company and did a H1 transfer and processed a new H4 for my wife. All this happened a month before the arrival of my wife's H1. In this case, when I take up your way, my wife and I just needs to go for H4 stamping or we need apply for H4 once again?

Since it is just above 2 months Does USCIS provide any grace period and go ahead accepting the COS?

My wife got her H1 approved on Oct 28 2013.She did not get any opportunity until now and is pregnant.I would like to know the answers for the following questions.

1. Documents required for filing the COS from H1 to H4
2. She doesnot have her paystubs up till now. Can I apply for COS without her pay stubs and what are the constraints?

My wife is here on H4 visa and now she got her H1 approved for the 2014 CAP. She got her approval last week and started looking for opportunities. The consultant who applied her H1 also started marketing her profile . I would like to know if there is any time frame before which she has to find the job and what is the implication if we cannot find an opportunity. If there any possibility to change status between H1>H4>H1 as per our convenience of finding the job. Is there any restrictions on this rule ?

Hi Karthik,

Please provide your inputs to the above mentioned question. Apart from this I had another option in my mind. Please share your thoughts on it as well.

I apply for my H1 transfer by end of July along with my spouse H4 transfer in premium processing.My spouse 's H1 sponsoring company submits the response to the RFE almost at the same time.

Does the H4 Transfer and my spouse H1 Processing clash or the USCIS take up whichever is recent and process my spouse H1?

Is there anything wrong in doing both together at the same time?

Even though as you have said it is not necessary to go about with my spouse H4 transfer as her I94 holds her stay till Feb 2014.I heard that we need to apply for her extension 5 months prior to the expiry of I94 which will be around September 2013.In this case doing a transfer along with my H1 looks to be feasible.Please share your opinion on this.

Thanks again for your response.
So if i am initaiting my H1-B transfer with my new employer now and i get it in three weeks, my H1-B would have my new employer. In that case, will my wife's H4 visa which is with my old employer will be still active ? even if the I-94 mentions Feb 2014 as the expiration date ? If my wife's H4 loses its life beacause of my H1-B being transferred, then isnt it an out of status situation for my wife as the H1-B approval for her might take one or two months .

Thanks for your response Karthik. The expiration date for my H1 /my wife's H4 , and I-94 is 07-Feb-2014. Based on your response I understand that I should do H1-B transfer alone and not do the H4 transfer for my wife. Once my wife gets her H1-B approved , she can get a new I-94. Hope my understanding is correct ?
