Hi,
We are planning to file an appeal. I submitted the following with RFE

1. 8 additional letters that include a letter from an Editor of a journal for which I have reviewed atleast 10 manuscripts.
2. list of citations to show that 70% of the citations were independent.

The letters were well drafted. I did not expect a denial. the IO denied all our claims. In the conclusion he mentioned that it is a routine job of a researcher to do research, publish papers, present abstracts in conferences and review papers. He acknowledged the letters written by experts, the articles published by me and the citations that my articles have got. Though I am the first author in 18 of my publications, the work was carried out by me as a graduate student or as a postdoc. Graduate students and postdocs generally work under a mentor and the IO is not ready to accept it as original contribution. For these reasons, he can not place me as one in the top few percentage of people.

Hi akmm,
Thank you very much suggession. Actually I went through a lawyer.

Initially, I submitted 9 letters -
3 from the advisors. they wrote clearly about my leading role in the projects.
One from the colloborator
3 independent letters
2 independent letters from the people in US who cited my work

Invitation letters from the editors to review manuscript- The invitation letters clearly showed that I was invited based on my expertise and contribution in the field


While responding to RFE, I submitted 7 letters.
2 from my advisors again mentioning my role and the importance of the work.
3 independent letters from the experts outside USA who cited my work. They also wrote about the significance of my work
one independent letter
one letter from Editor supporting my petition.

I also submitted the citation list to show that about 70% of the citations were independent citations

We did our best. We were very confident about the case. I don't know what went wrong. I am waiting for the denail letter. I'll let you know once I receive the letter.

The RFE was about 4 pages. the IO basically questioned all our claims.

He mentioned that all researchers are expected to work and publish their results. just publishing 20 articles will not fulfill the criteria.
'Citations means not just citing one's work in the footnote. The author's name should appear either in the title or in the abstract of the publications to claim his as an extraordinary ability alien'
Just reviewing few articles does not make one as a extraordinary ability alien.
original contribution-postdocs work under the mentorship of an advisor. so I should not claim the work as my original contribution.

I submitted 7 additional independent letters as a response to RFE. but still it was denied. I have to see the reason for denial. The probably i will go for MTR.

I was very much confident. My credentials are
working on biological chemistry
20 publications with 18 as first author
185 citations
8 conference presentatons
reviewed atleast 15 articles for 4 journals.

Initially submitted 9 letters. Then submitted additional 7 letters while responding for RFE

I am waiting for the denial letter. I will then go for appeal.

We submitted only the new document. The IO had already gone through all my documents. There was a four page RFE and in the RFE he explained about all the points that we claimed in the original petition. It has been a week since we submitted the response. I have to wait and see howlong it is going to take for the USCIS to give me a decision
