They should do all security checks before a person is granted any U.S. visa to enter U.S. That way people don't come to U.S. and waste their time trying to go through these checks, and can at least have a more predictable life back home until their security checks are complete. Priority date is the date when your labor/PERM application is received by the USCIS, and USCIS assigns a receipt date to it. Priority date is not based on filing category or nationality. It's first come first served.
Regarding your second question, PERM is the new labor filing process. It's a one-step labor certification process that is supposed to be quicker than traditional RIR or non-RIR processes. All new labor applications are filed as PERM applications at one of the two centers -- atlanta or chicago -- depending on where you are filing from. |

What's your priority date? As long as your priority date is current, I don't see why you can't file your I-485 semi-concurrently. What reason did your lawyer give for not being able to file semi-concurrently? |

I think the notice date is mentioned along with the Receipt date on the acknowledgement you receive from USCIS. This is the I-797 document I believe, it's also called Notice of Action. The receipt date is when USCIS receives your application, and notice date is when they "notice" your application :) Anyway, I think the notice date is when they enter your data in their system or something. Usually it's the notice date that is the more important date, but it's only few days later than the receipt date, so not to worry. If you don't know your notice date, no big deal. |

I think you should be able to file multiple I-140's. However, don't expect to file multiple I-485's because USCIS has a system that checks whether the same applicant is applying for two visas. They don't consume two visa numbers for the same applicant.
Regarding your other question about filing I-140, I think you need to file the I-140 petition within 45 days of the labor certification being approved. I remember reading about this a while ago (look at http://www.murthy.com/news/n_endsub.html or http://www.masudafunai.com/eng/legalupdates/publication-view.asp?eid=1371).
But I'm no expert. The current law may have changed. As always, seek expert advice :) |
