05/19/2016: Agenda for "Final Rule" Making Process for Modernization of Employment-Based Immigration System, aka I-140 EAD Reform

The high-tech foreign workers have been anxiously waiting for USCIS completion and implementation of "final rule" making process since comment period was over for the published "proposed" rule. The record reflects that the USCIS has a plan to submit the draft of the final rule to the OMB within this month, May 2016. It is hoped that the USCIS keeps this agenda and completes and implements this reform rule as soon as possible. Please stay tuned to this website for the progress of this final rule making process.

Just happened in the Republican debate. Trump supports immigration of highly skilled workers. He said he wants skilled people here.



Yeah...I was surprised to hear that..he clearly said he was changing the policy towards the skilled....he now thinks the skilled brain needs to remain in the country...

I saw the below note from the USCIS website--Official Memorandum

Based on it, it looks like, the labor need not be re initiated and only 140 needs to be filed by the new employer. Any thoughts...?

Question 9. Must a successor employer in an I-140 portability case provide a new labor
certification?
Answer: No. There is no requirement that successor employers in adjustment portability cases obtain a
new labor certification for those occupations traditionally requiring one. AC21 also provides that any
underlying labor certification also remains valid if the conditions of �§106(c) are satisfied. The
beneficiary of an approved labor certification may benefit from it although the alien seeks to adjust
on the basis of different employment.

I wouldn't worry much about stamping as the interview waiver program is valid within one year of visa expiry even with a new employer.

The proposed rule indicates that those with the approved I-140 petition will enjoy portability of the approved I-140 petition once 180 days pass from the date of the I-140 approval. If the approved petition is withdrawn by the sponsoring employer within 180 days of the I-140 approval, the USCIS will revoke the approved I-140 petition and he/she will not be able to use it for portability or for I-485 application in the future using the approved petition. Meanwhile, if he/she ports after 180 days of approval of the I-140 petition, even if the sponsoring I-140 petition employer withdraws the approved petition, the USCIS will not be able to revoke the approved I-140 petition and such approved I-140 petition will remain valid unless it revokes based on its determination of misrepresentation or fraud or error of the agency in approval. For the reasons, practically the proposed rule requires that the beneficiary of the approved I-140 petition should not change employment for 180 days, even if for a same or similar occupational classification. Inasmuch as he/she changes the employment after 180 days of I-140 approval, the new employer does not have to sponsor another PERM application and another I-140 petition to keep him or her without affecting his/her green card eligibility. One catch is that unlike the current law, the new employer will have to certify that the job is a same or similar job and the job will continue to exist through the time of approval of his/her green card application. Under the current law, I-140 sponsoring employer and the foreign worker must attest to such facts, but not for the new employer who hires a foreign worker using the approved I-140 portability. Another catch is that because of the restrictive requirement of EAD eligibility for such foreign workers, as this reporter reported earlier, the proposed rule practically asks the foreign workers to keep working for a new employer using one of the employment authorized nonimmigrant visa classifications.

Gurus, I plan to travel to India in August and need to get my H1B stamped. My previous stamping was in Chennai; but can I go to Hyderabad this time? I see information on some sites confirming that renewal can be at any consulate; but wanted to reconfirm. Also, for getting an appointment earlier, which consulate is better, Chennai or Hyderabad or it doesn't matter?

I lean to believe that the 'good news' was supposed to come with the VB yesterday, and for some reason, they couldn't (or decided not to). I also believe that's the reason they say few more weeks (may be next VB), and giving the fake reason as a tech glitch. Otherwise, there is no reason to consider it a time sensitive announcement and IV giving a heads up to prepare the docs, so that no one unreasonably misses the boat.....
