Topic: Travel on AP and Job Change
Hi,
My I-140 is approved in 2006 and I-485 is pending for more than 2 years. I am still working with same company, who sponsor my GC, and got another 3 years of H1 extension.
I want to visit India and come back on AP (My h1 visa on passport is expired). I am also looking for change of employment and most probably will get a job who will sponsor H1-b and AC21 for me.
Now my question is if I change the job first and then visit India using AP.
Will that can be issue at POE?
After the India visit, what will be my status in new company AOS/AP?
What will happen incase of any issue with pending AOS? Do I have to go out of US to get visa stamp or it won't impact me because I will have H1 from new company too.
If I visit India now and change the job after coming back.
Can I extend my H1b from new employer?
What will be my status with new employer?

There is one more post as State Department Predictions at http://www.immigration-law.com/
As per this the EB3-I will move to Jan/Feb 2002 in FY 2010. So which one is correct 5 weeks or jan/feb 2002.
Am I missing something here...just trying to understand the predictions.

* EB-2:
o China: July through October 2005
o India: February through March 2005
o (If Section 202(a)(5) were to apply, China and India: October through December 2005)
* EB-3:
o Worldwide: April through August 2005
o China: June through September 2003
o India: January through February 2002
o Mexico: January through June 2004
o Philippines: April through August 2005

12/12/2009: Additional Information on State Department EB Visa Number for FY 2010 Predictions as to Timeline
* AILA reports that the State Department official discussed some of the EB visa number predictions in November before the January 2010 Visa Bulletin was released. The information is very much coincide with the Visa Bulletin. However, the information gives prediction of visa number progression timelines for various EB visa categories. The timeline predictions appear to be:
o Worldwide EB-3: The cut-off date was predicted to start to move forward in January or February 2010.
o India EB-3: There were 58,000 applications pending for the FY 2010 and it predicted that numbers would move forward up to 5 weeks altogether for the entire FY 2010.
o India and China EB-2: State Department predicted that annual limits would reach no later than May 2010, but because of the anticipated otherwise unused 2nd preference visa numbers, the cut-off dates may progress to October-December 2005. It is a promising information which was not made available in the Visa Bulletin. But prediction is a prediction and people will have to wait and see.
* Considering the terrible EB-3 prediction for Indians, the EB-3 prediction for worldwide is considered more or less promising.

EB3-I is suffering because USCIS change the practice in 2008.
Earlier unused visa from EB1 and EB2-Row was available for all but now it's only available for EB2-I/C.... It's really much better for those who filled in EB2...
but again it's my mistake too, my case got filled in EB3 category even I was eligible for EB2.... |

I too want to file new labor and I-140 in EB2 to convert my case from EB3 to EB2 with APR-03 priority date but my employer is not ready to do that...
What option I have...In this market it's really tough to get a job with new employer who can sponsor GC....
Sometime I feel so bad about the fact that my case got filed in EB3..... |

That's true they used unused FB visa from previous year but
what I read is that they have wasted around 10k from the total number (140 k EB for FY 2008 + Unused FB visa from FY 2007)
I may be wrong… as I don’t remember the source… |

hmmm... Although I am not sure but read somewhere that even last year they wasted around 10k visa...
for them it's 10k visa out of 140k .....for us 10k visa is peace of mind from 'never ending GC drama' to around five thousand family... |
