Last week my wife's H4 EAD finally got approved. The case status changed to "Case Was Approved" The date approval was Aug 11 2015. application number: EAC15906825**.

I have updated the tracker with the info.

Thanks a lot to everyone for this concerted effort.

I have a couple of questions:
- How long does it take to get the EAD card? It has been a week since the case was approved. We havent received the card yet. We called USCIS, and they told it would take upto 60 days to get the new card. Is it true? My wife was planning on taking up a job ... if it takes 60 days its too long a wait.
- Can you take up a job with just the "Approval Notice"? I believe not. Wanted to confirm.
- Once the card is received, can you take up a job? or do you have to apply and get the SSN before joining the new job?

If it helps I was tracking the 1000 cases from EAC1590682000 to EAC1590683000 over the last week.

As of Jul 14
USCIS had 531 cases in this series for which they did not yet start processing [ meaning status was"case Was Received"]

As of Jul 22
USCIS had 372 cases in this series for which they did not yet start processing

So in the 1 week interval USCIS processed 159 cases in this series. Unfortunately my wife's application is one of the 372 that has not yet been processed.

Based on this I am hoping they will start processing our application in the next week and a half.

The weird thing I notice is that the unprocessed Application appear to be clumped together. They are not evenly distributed in the series. I see one clump of unprocessed apps followed by a series of processed application then another bunch of unprocessed apps etc.

So I am guessing USCIS is bundling applications and processing random bundles in the case number series, which corresponds to the date of reception of the applications.

I will keep monitoring this series regularly.

what a day it has been. I am very glad and thankful to have acquainted with a great set of people here united in pursuing a cause. Thank you every one. Now lets wait to see the time line of regulations. H4EAD I guess will become a reality in Dec/Jan. which is a wonderful news for most H4 spouses who have been forced to stay at home waiting for the PD to become current! We got to stay tuned regarding upcoming regulations that will allow us to file for AOS/EADbegore the PD becomes current. Yesterday I did not understand all the ramifications. Now I see BO's plans were brilliantly done within his limited authority. Kudos to every one of us who kept the pressure on the administration to make this a reality.

EO and the rule are separate tracks. Its been encouraging to hear that the rule is projected to be published by end of the year. The rule is a done deal. Its not a question of IF... but WHEN.

EO is a different matter. Some members seem to confuse the EO with the rule. EO is speculated to include some legal immigration fixes including potentially GC. And I personally think Mr.O will include EAD for H4 in it as well as its a low hanging fruit with a rule that was vetted thoroughly and already prime for publication.

But regardless of whats in the EO the H4 EAD rule will prevail. Even if GOP manages push Mr.O to backtrack the EO [ seems unlikely] the H4EAD rule will still prevail as its a standalone regulatory action. And hence its not contingent upon the EO. The good thing about the dual track is that even if EO gets overturned or president changes etc, the rule change will prevail.

So simply put from my perspective of a follower of the H4EAD thread, the H4EAD is the cake we have been fighting for, and the passage of the EO with its potential GC fixes are an icing.

Although many of us are convinced at what may be in the EO, some of us [ like kumraj] seem to pointlessly prolonging the conversation by giving pseudo facts on the unknown content of the EO. Until we hear it from Mr.O's mouth every one can claim to be an expert. And these pseudo-experts [like kumraj] are unable to discern the fact that opinions arent facts and try to condescend over any other contrary opinions. Proof is in the last 5-10 pages of pointless rebuttals. The point is to respect everyone's point of view and get rid of the know-it-all condescending mentality.

Anyway, Lets see whats going to happen on 11/20. My guess is probably Mr.O will release a framework of whats possibly in the EO. Then he will wait for the lameduck session to get over before he will officially release any EOs. And in the mean time I am hoping USCIS readies itself in parallel for the H4EAD publication.

Thanks Kamakazee for representing us. With many of us on the other coast of the US I am thankful that atleast some one can attend on our behalf. Irrespective of whether Leon took the question or not, the fact remains that the questions reached the upper management of USCIS.
Its also encouraging to know that USICIS is preparing for the EOs. Lets see how the ball rolls.

wow.. dems have taken a drubbing yesterday. Based on some reports, latinos have really abandoned the election or voted against dems due to obama's continued inaction on immigration. Path for Obama will get tougher after january, when the Reps take control of both houses.
So to atleast save some face I am hoping he will pass the EOs in the lame duck session. Otherwise any immigration related fix will that comes out after January will be touted as a repub's achievement and will hurt Dem's chances again in 2016.
I am hoping H4s get the EAD either through the rule or through the EO by end of year before repubs take control of senate and its commitees in Jan.

I agree. we need to focus on the H4 rule. However I am afraid, DHS may be holding off since administration is considering the EO.... just like a year or two ago when the OMB held off due to the possibility of the elusive CIR.

this is quite frustrating. Althought I did not have great hopes when the year started... my expectations were raised when our email/fax campaign and meetings with OMB moved the rH4 rule into comment period. Then statements from Jeh Johnson and Leon Rodriguez about expidited processing of this rule further raised my hopes. Then last few weeks have been a roller coaster with Obama flip flopping on the EOs.

There is absolutely no possibility of immigration bill clearing the house. So EO or rule change is the only way out. And we legals dont have as much sway or lobbying infrastructure as undocumented immigrants. basically the politicians do not see us as voting blocs. Otherwise we would not be in this plight.

Having said all these.. we have waited for years together in pursuit of this rule change. I believe its not a question of if this rule will pass... its a question of when... Having waited for 2-3 years on this rule... I think its not bad waiting for a couple of months.. But that is not really an acceptable situation that the incompetent politicians in DC are forcing us into. We need to raise our voice more vigorously now. we should intensify the phone, email and fax campaign. Talking to local congressmen/senators is a good option. But I personally feel its a blind end as these guys are trying to not get involved in this process as they want to play it safe until November.

I am holding my reservation until end of summer... hoping Obama will one again flip flop once more to pass the EO. But I know thats just a dream now. I guess we are also DREAMers now! Most likely Obama is waiting to do this in the lame-duck session after November. Let us continue our campaign in the hopes that they atleast listen to our rational view points. If we stop now they will defer it for next year.

I think let us wait for a few weeks for the process to play out. If there is no info then we can possibly contact DHS/USCIS/OMB etc. In the mean time, I am trying to collect some new contact details. we already have our old list of emails.

Please dont feed the trolls. The last 3 pages have been having a lot of negativity both from the trolls as well as from our responses. Let the RK sharmas of the world keep blabbering their heart out brandishing their ignorance. We know that they are just nonsense. So why bother to retaliate with name calling. So let us ignore the trolls and rejoice at the completion of a successful comment period.

That being said, a huge thanks to the whole trackitt h4-ead members and h4-ead facebook group and every one else involved in making this possible. Next up we need to re-group again to track and push for the progress and eventual implementation of this rule. We cant let OMB sit on it for another year. But from statements from Jeh Johnson and Obama, we can expect a fast track for this rule. Fingers crossed!!!!
We have won the battle. But we still have a war to win. Lets march on without unwanted distractions like RKsharmas.

did you guys notice that most of these negative bullshit is coming from people who do not wish to disclose their names? In my opinion, A person not confident enough to put his name behind his ideas is not worthy of consideration. I think anonymous comments do not carry much weightage in the legal process.

Looks like we will know more in a few weeks. Given that Jeh Johnson and Obama have repeatedly hinted at fast tracking this rule, I am hoping we dont see another insanely long OMB review. I think with elections coming near they may want to fast track this to appease the tech sector. But we never know. So I think we should once again get ready for some kind of a meeting with the OMB in Late August if nothing pans out. We may also have to re-organize another phone/fax/email campaign again, if the rule once again goes into prolonged reviews. We will wait and see how things move in the next few weeks.
