Topic: Stuck in "Supervisory Review"

Is there anyone out there who's file is or was under "Supervisory Review"?
If yours is/was...

A. For what reason

B. How long did it take them to make a decision on your case once it went under "Supervisory Review"?

C. Was the result approval or denial?

My lawyer has informed me that my file is under "Supervisory Review". She also commented that when the adjudicating officer hands the file over to a supervisor, it's because the officer needs approval to deny the case. She says the outcome for me doesn't look good. At my second interview in April 2008, my passport was not stamped. Instead, I was issued an RFE to submit recommendation letters from my friends and family. The IO said it was because I used AP to leave the country. I had used the AP because I went to Mexico to attend my fathers funeral.

PLEASE, Anyone who's case is or was under "Supervisory Review" respond with your experience and or advice.

Topic: Waiting on EAD Card

Projae, I got an email from USCIS requesting additional information for my EAD application on Aug 18. I never received the letter in the mail describing what they needed me to submit, nor did I ever send them anything. Today, Sept 4, I got another email from USCIS stating they received the requested information and processing has resumed on my I-765 (EAD) file. I've never seen anything dumber than your situation or mine!!!! WEIRD!!!

Topic: FBI NAME CHECK DELAY 2 YEARS AND MORE!

I have been stuck in the FBI name check for 6 years. I've had 2 interviews and still no approval for marriage based I485/I130. The Michael Aytes 180 day name check memo is worthless. Instead of giving me my green card, USCIS just got me for another fee to renew my I765 Work Authorization card. I've already tried all the avenues mentioned in your post to try to get my file approved. Hopeless :/

Topic: RFE email notice to letter in hand

I received an email notice from USCIS stating that I had been issued an RFE for my I-765 EAD application on August 18, 2008. In the email they stated a letter explaining what is needed from me was mailed out the same day. It's now August 27, 2008 and I haven't received the letter in the mail yet. Does anyone know what the average number of days it takes to get the RFE notice in the mail after receiving the CRIS email notice for RFE? Starting to get a little worried that the post office has lost my letter and I know I will have a deadline for submitting the requested documentation. Thanks for anyone's experience advice.

I had my second interview on April 8, 2008 & was issued a RFE. I sent in the requested info on May 1, 2008. Still haven't heard anything from them. 82 days and counting. :/

If any of you have some extra time, read the Citizenship & Immigration Services Ombudsman's 2007 Annual Report to Congress...all 145 pages of it. It will give you a good idea of what we are REALLY dealing with. On page 21, the Ombudsman describes the USCIS as a "Self-funded government monopoly"....now, I can see why they got me for more fees. You will see how disorganized and transparent the adjudication process really is.

Yes, Yes! That is what I'm saying! I can't imagine why this has happened to me...no reason for it! I'm not sure why I've been singled out. I am telling the whole story to all of you. Believe me, it's killing my brain over here trying to figure it out.
I even gave USCIS a copy of my father's death certificate which matched the time period for which I was out of the country. I don't get it, what more proof do they want? Also, what if I would have left just for a vacation? What validity would I have to prove other than extreme bordom!! Not fair at all.

Miserable, There are no other underlying reasons for the RFE. My IO specifically said the reason for the RFE was because I traveled outside the US using AP. She stated, "I have to ask for the letters...it's the law now". My opinion is that she's full of sh*t. I've asked other Trackitters who have been recently approved if they traveled using AP while under adjustment. Most of them had (just for vacation purposes). Some of them had left the country 3 to 4 times. These people received their Green Cards with no problems. Either my IO is the only one who is following the rules...or she's making her own rules up as she goes along. I have a congressional representative who has made an inquiry to their immigration liaison, basically to verify such a rule does exist. USCIS charged me $540.00 to submit the form required to hand in the letters. Everything has a price tag with these guys. Sometimes, I think they just wanted to extort more money out of me. They know I'm desperate to see my GC and figure I'll fork over the cash to get it no matter what. Since that happened to me, I've made it a point to warn other people about using AP. Be very cautious.

I left the country using Advance Parole to attend my fathers funeral in mexico, so The IO issued me an RFE requesting me to submit 10 "Good Character" recommendation letters written by my friends and family. I submitted the letters on May 1st and haven't heard anything since...except they called me in on June 19th to renew my fingerprints. I've called the FBI twice since then to see if the results have been returned back to USCIS...each time the answer is "USCIS hasn't sent them to us yet".

Contemplating...I had my 2nd interview in April 08 & was nailed with an RFE....still waiting for approval since 2003. I was so sure I would get approved at my 2nd interview. I'm hoping yours will go better than mine did. GOOD LUCK!!! :)

Topic: Green Card before EAD card

Has anyone gotten Green card approval before EAD card arrives? I had my second interview on April 18, 2008 and was issued a RFE to submit recommendation letters from friends and family. I turned in the letters on May 1, 2008 and at the same time sent in the paperwork to renew my EAD (it was due to expire). This was the 4th time renewing it since 2003. I was called in to USCIS for another fingerprinting on June 19, 2008. Does anyone think I have a chance at getting GREENED before my new EAD card arrives? Instead of collecting the EAD renewal fee again, I wish they would have just approved me. Now, they are $340.00 richer and I still have no results. This is getting annoying.

Kinda funny. At my 2nd interview, my IO said to me, "You don't look Mexican & you don't even speak with an accent." (I have more Spanish in me than Mexican, so my skin is really light) I thought to myself...Duh! I've been here for 35 years. I own a house and because you gave me a Social Security number, I've probably paid more money to the IRS for employment and property tax than most US Citizens. The least they can do is give me a GC. I've gone thru all the right avenues and jumped through so many hoops over the years...I'm tired and need relief.

Soooo...They screwed up my first attempt to be a Permanent Resident and then screwed up my name check on the second application too. Actually I've been waiting for this since I was 5 yrs old...I'm 40 now.

Yep, When USCIS sent my name check to the FBI, they ran my two last names together as one word. After noticing the mistake, it took me 2 years to get them to re-submitt it again. That's why my name check has been pending for so long & my application hasn't been approved yet. Now, with this new name check memo I can get approved with out the name check being cleared. It really sucked that I've had to wait so long because of someone's data entry error. You know, USCIS never apologizes for their mistakes or does anything to compensate for them.

My parents are Permanent Residents of US. Unfortunately I was born while they were in Mexico. They brought me here when I was 5 yrs old. At that time I was given a Social Security Number and allowed to go to school in California. I once applied for my GC using my Mom as my sponsor, but the Texas office I applied thru was under investigation for Fraud...so my application was confiscated until the investigation was over. They told me to wait to hear from them, but they never contacted me regarding reinstating my application. I ended up contacting them & at that time was told I needed to go thru the entire process all over again (since so much time had passed from the initial application). By that time I was married to a US citizen and had 1 child. I no longer needed to use my mom as my sponsor & applied using my wife.

Hi deepak200, I'm always willing to share my crappy experience with anyone who will listen.

Filling date: March 6, 2003

1st Fingerprint : May 18, 2004

1st Interview: September 16, 2004

2nd Interview: April 18, 2008 - Issued RFE for leaving the country while under AOS (even though they gave me Advanced Parole...permission to leave)...I went to Mexico for my father's funeral. USCIS requests me to submit recommendation letters from my friends and family explaining my good character and why they beleive I should be allowed to stay in the country. Deadline to submit was May 17, 2008. (no passport stamp)

Submit Recommendation letters to USCIS on May 1, 2008

Received appointment letter to renew my fingerprints on May 27, 2008 (appointment is scheduled for June 19, 2008)

Ahhhh! Today I got a letter from USCIS. They want me to come in on June 16 to submit my fingerprints again! Geeez, at my 2nd interview (April 18, 2008) I specifically asked the IO if my fingerprints needed to be done again and she said, "No, everything looks good! Just submit the recommendation letters by the deadline and we'll send you a letter with the decision." When is this gonna end? Has anyone been approved after an RFE for new fingerprints? How long after the FP appointment did you have to wait til the approval came? Thanks alot everyone for your support...I'm getting frustrated with this unorganized, broken system. I mean, come on! That IO should have known at my 2nd interview that new FP were needed! I wonder if she even read my file.
