Topic: Will CIR pass by end of this year

You would think the immigration system/process must have been revised appropriately since they allow 65K H1B visas every year and considering most of them will file for immigration later on.

If they really cared, they would have revised it so EAD or GC could have been given to people who stayed here 6 years with clean record at the least. Instead it's locked at the the country based quota basis. Even people given GC through lottery get citizenship after 5 years. We should tell/advise fellow people/friends not to come here as they would eventually end up in the mess and get "used" themselves.

One of the reasons for not increasing the country quota is that they don't want many non-white people in the country. Yes it's racism which goes untold. Remember the history of this country has always been hippocratic, racist. Back in the days, citizenship was not given to non-white people.

Ask your nearest Afrian American friend and they will tell you the story of racism. This is the community which has been here since very long time and still face with racism now and then. So you can think/imagine what the situation would be against other non white communities.

If they can't help it or don't want to fix it, at least stop allocating new visas every year. I know , I know then corporate america probably would poke the government for their selfish/greedy needs and it won't be done. So now it's really comes down to every one of us to think and decide if you wanna deal with the mess and be a slave. I don't think dealing with the mess or be a slave is worth it. So going back makes sense to me.

Per country quota exist for a reason. The idea is to provide a diverse immigration but at the same time not to let create any imbalance at various levels at home. There is no way that the quota will be increased whatsoever but it probably will be cut off in future. Immigration in West will be cut down across the board as those countries won't be entertaining immigration anymore for various reasons.

Above reason is why Indians and Chinese are suffering under employment based immigration where they give out lots of H1B visas and people from these countries avail the most. The allocate these visas because of pressure/lobbying from the corporate america. Now it's like we give out H1B visas but we will not increase immigrant visas and people have to remain in queue until their turn. With lots of people coming in and with their family members included, the backlog started and it's piling up. It's a win-win process for corporate america and government which is actually an hippocratic process. So why would they really care of people suffering and fix it on humain grounds ( assuming they know people are suffering ) ? Even if you join American Arm Forces and put your life on the table, you won't get citizenship until after few years so you can think what you will get in other situation like ours. So it's in your own interest and self respect that you think what you want to do. Do you want to remain a slave/alien which is basically the outcome of the existing process or go back to your country and do something better for your country.

If I knew this mess, I probably wouldn't have come here but I'm planning to return by end of this year. I would rather put my hard work and life for my own country and make her "developed" than stuck here as an alien/slave.

Yes I do think "Munkin Hai"

I'm not sure what CIR has for legal immigration.

Can someone please provide a link or info about legal immigration clauses in the CIR?

Recently I heard that President wants to streamline legal immigration but don't know how he is going to streamline it. Anyone has any information about it?

Thanks

I think there should be these words "modern day slavery" in Item#2. Besides these letters, I think someone needs to actually meet these officials.

Topic: What happens when the employer withdraws approved I-140?

If the employer invokes the I-140, then wouldn't he invoke H1-B as well? meaning one could be out of status yes?

Topic: Will CIR Bill pass by end of this year ?

Like everyone else I'm in the same boat.

Some points --

Historically immigration in USA has always been controversial for various reasons .. Greed, Prejudice and Hypocrisy.

I don't think the CIR bill will pass ever. They are already deporting people anyway.

Employment based immigration is actually a broken system. I think it should be stopped immediately.
The greedy corporate america insists on skilled labor and they also outsourced the jobs.
American government don't want to give GC to skilled labor within legit period because of huge queue, they want your taxes but don't want to give citizenship benefits. It essentially means you are given a carrot and get your taxes, and keep you in limbo forever.

So both corporate america and government are playing games in their own ways and they really don't care about your status or college graduates coming from within the country or the citizen of this country for that matter. Meaning no justice to either of them.

Now you are stuck for years. It seems like this is a modern day slavery!
Why would you like to stuck or have to deal with this messy broken system.. really why?
Think about your and your kids future in america. Your kids may find it hard to get a job or respectful life in this country where crippling poor middle class and greedy corporates, upper class ( who are actually robbing this country ), racism exists.

You shouldn't have to wait for decades to get citizenship. DV Immigrants through lottery system gets citizenship after 5 years which is what the Immigration Act talks about.

So instead of wasting your precious years of your life here, shouldn't you think about going back to your country and help your country to prosper with your contribution?

Topic: I-140 approved - Changing employer

Hello,

Looking for some valuable suggestions/comments please..

I've I-140 approved with EB3 labor with PD 2011. Now I want to change the employer. My current H1B is valid until May 2015 and this is 10th year. Can a new employer file a H1B for me if he is willing or what option(s) do I've at this point?

Thanks

Topic: EB3 - Long wait - Alternate options?

Considering the pace of the EB3 movement, God only knows when the priority of 2010 will become current. So what alternate options/avenues one could explore to be able to apply for I-485 sooner?

Thanks

HR 3012 was passed in Nov'11. It seems it has benefited EB2 mostly. I haven't seen any benefits to EB3. Am I missing something?

Hi,

Does anyone know if this switch over is possible after EB3 PERM was approved and the candidate becomes eligible per
EB2 requirements? If yes, at what stage this switchover can be done?

Thanks in advance

Thanks for your reply. Yes I meant "before".

So does it mean that in the bulletin chart 1st is EB2? 2nd is EB3?

Hi,

Please excuse my lack of knowledge as I am still trying to understand this whole process.

How come the PD 07/25/2008 is current? I thought dates after the month mentioned in the visa bulletin are considered current?

Thanks

Topic: H1-B Masters Degree program

Hello,

I understand that there is a cap of 20,000 special visas for U.S. Master's Degree candidates.

Does anyone know if the Degree has to be a full time or part time and online degrees are also considered?

Any link or a way to know the list of companies who sponsors these candidates and list of universities whom degrees are acceptable ( in case it really matters ) under this special cap?

Also if someone is already on H1-B and completes his/her Masters degree from an US university before 6 years and some company is willing to sponsor, can the company apply under this special cap visa? If yes, Does the new H1-B entitle a new term of 6 years for the candidate?

Thanks in advance
